Sealed bids for the construction of a Post Anoxic Reactor (PAR) tank at the Sudlersville Wastewater Treatment Plant (575 Thunder Road) in northern Queen Anne's County, Maryland will be received from qualified bidders by the County Commissioners of Queen Anne's County at the Queen Anne's County Sanitary District, 310 Bateau Drive, Stevensville, Maryland 21666 until 9:00 a.m. local time on September 1, 2026 at which time they will be opened publicly and read aloud. Note this is a different location than the pre-bid location.

The overall project is to enhance the plant’s nitrogen removal processes which are currently inadequate to reliably meet permit standards.

The work of this contract, Contract No. SAN 26-01, consists of the rehabilitation of the existing Biolac reactor via the removal of accumulated sludge and the full replacement of the air diffusers, replacing and enhancing the current chemical feed delivery system, the construction of a cast-in-place concrete PAR tank, and associated electrical and system control facilities.

To that end Bidders may visit the site prior to the pre-bid at 9:00 a.m. Bidders shall coordinate with the County Project Manager for site visits beyond the one associated with the pre-bid meeting.

INVITATION TO BID

A notice of an addendum posting will be sent to all known plan holders. Any Addenda
issued shall be issued via electronic posting on the ebidmarketplace.com and Queen
Anne's County Procurement websites. However, it is the Bidders responsibility to
ensure receipt of all addenda.

Bidders on this work will be required to comply with:
1. The President's Executive Order No. 11246 as amended by Executive Order
11375. The requirements for bidders and contractors under this order are
explained in the Contract Documents.
2. The facilities to be constructed under this Invitation to Bid will include funds
from the Maryland Bay Restoration Grant Fund. Bidders will be required to

comply State requirements pertaining to minority business enterprise and
women's business enterprise.
3. The Maryland Prevailing Wage Rates labor standards provisions are
applicable to this contract.
4. The successful bidder will be required to place both a Performance Bond
and a Payment Bond, each in the amount of 100% of the contract price, and
a Maintenance Bond in the amount of 5% of the contract price.
Each Bidder must submit a bid security of not less than five (5) percent with his bid, in the
form and subject to the conditions provided in the Instructions to Bidders. Bids to remain
open for 150 days. No bidder may withdraw his bid within one hundred fifty (150) days
after the actual date of the opening thereof in order to secure Board of Public Works
funding.
The Owner reserves the right, in the exercise of its sole judgment, to reject any or all
Bids, and to re-advertise and award the Contract in the regular manner, or to waive any
informalities, irregularities, mistakes, errors or omissions in any Bid received and to
accept any Bid deemed to be responsive to this invitation and favorable to the interests
of the County.

INSTRUCTIONS TO BIDDERS
1. DEFINED TERMS
1.1 Terms used in these Instructions to Bidders, are defined and have the
meanings assigned to them in the General Conditions.
1.2 The term "Lowest Responsible Responsive Bidder" means the Bidder to
whom OWNER (on the basis of OWNER's evaluation as hereinafter provided)
makes an award on the basis of the total bid.
1.3 The term "OWNER" as used in the Contract Documents refers to the County
Commissioners of Queen Anne's County. Project Manager for the OWNER
shall be Matt Lucas, Chief Sanitary ENGINEER, Department of Public Works,
Queen Anne's County, Department of Public Works, 310 Bateau Drive,
Stevensville, MD 21668, phone number: 410-643-3535. E-mail:
mlucas@qac.org.
1.4 The term "ENGINEER" refers to the engineering firm shown on the design
drawings. All inquiries during the bidding period should be addressed to the
OWNER's Project Manager who will distribute the questions to the
ENGINEER as necessary.
2. COPIES OF BIDDING DOCUMENTS
2.1 Complete sets of the Bidding Documents may be obtained digitally as noted
in the Invitation to Bid.
2.2 Complete sets of Bidding Documents shall be used in preparing Bids; neither
OWNER nor ENGINEER assume any responsibility for errors or
misinterpretations resulting from the use of incomplete sets of Bidding
Documents.
2.3 OWNER and ENGINEER in making Bidding Documents available on the
above terms do so only for the purpose of obtaining Bids on the Work and do
not confer a license or grant for any other use.
2.4 It is the Bidder's sole responsibility to ensure they are in receipt of any and all
addenda issued in the preparation of their Bid as is stated in the Invitation to
Bid.
3. QUALIFICATIONS OF BIDDERS
3.1 All Bidders must be able to demonstrate that at least 50% of the Work (by
dollar) is to be completed with their own forces.
3.2 To further demonstrate qualifications to perform the Work, each Bidder must
be prepared to submit within five days of OWNER's request, written evidence
such as financial data, previous experience and evidence of authority to
conduct business in the jurisdiction where the Project is located.
4. EXAMINATION OF CONTRACT DOCUMENTS AND SITE
4.1 Before submitting a Bid, each Bidder must (a) examine the Contract

Documents thoroughly, (b) must visit the site to familiarize himself with
local conditions that may in any manner affect cost, progress or
performance of the Work, (c) familiarize himself with federal, state and local
laws, ordinances, rules and regulations that may in any manner affect cost,
progress or performance of the Work; and (d) study and carefully correlate
Bidder's observations with the Contract Documents.
Bidder shall correlate the information known to Bidder, information and
observations obtained from visits to the Site, reports and drawings identified
in the Bidding Documents, and all additional examinations, investigations,
explorations, tests, studies, and data with the Bidding Documents and
promptly give OWNER and ENGINEER written notice of all conflicts, errors,
ambiguities, or discrepancies that Bidder discovers in the Bidding Documents
and confirm that the written resolution thereof by OWNER and ENGINEER is
acceptable to Bidder.
4.2 Reference is made to the General Conditions and Supplemental Conditions
for the identification of those reports of investigations and tests of subsurface
physical conditions and subsurface utilities at the site or otherwise which have
been relied upon by ENGINEER or their agent in preparing the Drawings and
Specifications. OWNER will make such reports available to Bidder via
Appendix A. These reports are not guaranteed as to accuracy or
completeness, nor are they part of the Contract Documents. The Contractor
must assume all risks in excavating for this Project and shall not be entitled to
rely on any subsurface information obtained for the ENGINEER or indirectly
from the OWNER. Bidders, in using this information, thereby release
OWNER and ENGINEER of all liability as to the information contained within
the subsurface information, and such Bidders accept such subsurface
information in accordance with the provisions of the General Conditions.
Before submitting his Bid each Bidder will, at his own expense, conduct such
investigations and tests as the Bidder may deem necessary to determine his
Bid for performance of the Work in accordance with the time, price and other
terms and conditions of the Contract Documents.
4.3 If the Bidder does not take advantage of the site visit planned prior to the pre-
bid, and upon 1 week in advance notification, OWNER will allow each Bidder
to access the site in order to conduct such investigations and tests as each
Bidder deems necessary for submission of his Bid. Bidder shall coordinate
with the County Project Manager to access the site.
4.4 The lands upon which the Work is to be performed, rights-of-way for access
thereto, and other lands designated for use by Contractor in performing the
Work are identified in the Supplemental Conditions, General Requirements or
Drawings.
4.5 The submission of a Bid will constitute a representation by the Bidder that he
has complied with every requirement of this Article 4 and that the Contract
Documents are sufficient in scope and detail to indicate and convey a

complete understanding of all terms and conditions for the performance of the
Work. Bidder agrees at the time of submitting its Bid that no further
examinations, investigations, explorations, tests, studies, or data are
necessary for the determination of its Bid for performance of the Work at the
price(s) bid and within the times required, and in accordance with the other
terms and conditions of the Bidding Documents.
4.6 Bidders who do not undertake the mandatory site visit will have their
Bid rejected and unopened at the scheduled Bid opening. Bidders who
do not take advantage of the pre-bid visit must provide prior notification of the
visit to the OWNER in order to document their visit.
5. INTERPRETATIONS
5.1 All questions about the meaning or intent of the Contract Documents shall be
submitted to OWNER's Project Manager in writing at least fourteen (14) days
prior to bid opening. Questions received later than that date will not be
answered. Replies will be issued only by Addenda made available not later
than seven (7) days prior to bid opening. Failure of any Bidder to receive such
Addendum shall not relieve Bidder from the obligations under the Bid as
submitted. Only questions answered by formal written Addenda will be
binding. Oral and other interpretations or clarifications will be without legal
effect.
6. BID SECURITY
6.1 Bid Security shall be made payable to OWNER, in an amount of five (5)
percent of the Bidder's maximum Bid price and in the form of a certified check,
bank cashier's check, or a Bid Bond on form attached, issued by a Surety
meeting the requirements of paragraph 6.3.
6.2 The Bid Security of the Lowest Responsible Responsive Bidder will be
retained until such Bidder has furnished the required Performance Bond and
Payment Bond and executed the Agreement whereupon it will be returned. If
the successful Bidder fails to furnish the required Contract Security within 10
days of the Notice of Award or fails to execute and return the Agreement within
ten days of the Notice of Award, OWNER may annul Notice of Award or the
Notice of Award and the Bid Security of that Bidder will be forfeited. The Bid
Security of the three apparent lowest responsible responsive Bidders may be
retained by OWNER until the earlier of the seventh day after the "effective
date of the Agreement" (which term is defined in the General Conditions) by
OWNER to Contractor or ten days after the time specified for Bids to remain
open. Bid Security of other Bidders will be returned within ten days of the Bid
opening.
6.3 All bonds submitted as Bid Security shall be executed by surety companies
legally authorized to do business in Maryland. Such surety companies shall
also be named in the current list of "Companies Holding Certificates of
Authority as Acceptable Sureties on Federal Bonds and as Acceptable
