Description

The Town of Banff is seeking the services of a heritage or planning consultant to investigate, develop, and draft amendments to the Town of Banff’s Land Use Bylaw to help promote the conservation of heritage buildings, while also providing other opportunities, such as development on these sites.

A variety of policy and Land Use Bylaw amendment tactics were identified in the Heritage Resource Action Plan (HRAP), approved by Banff Council in 2024. At the January 6, 2025, Special Meeting of Council, Town of Banff Council approved a project to implement Land Use Bylaw amendments related to district regulations, general regulations, specific use regulations, approving authority and variances. This corresponds to the following tactics identified in the HRAP that should be investigated as part of this project, further outlined in Appendix B:

o Time extension for permit compliance (Tactic 1)
o Adjust approving authority (Tactic 11)
o Wider Range of Uses Permitted (Tactic 12)
o Transfer tools (e.g. density transfers) (Tactic 13)
o Land Use Bylaw Amendments by District and Town-wide (e.g. changes to setbacks, limits to density, limits to height, etc.) (Tactic 17 & 18)
o Improve/add certainty to Land Use Bylaw variance process (Tactic 19)
o Extend timeframe for compliance for required housing (Tactic 20)
o Accessory dwellings (Tactic 21)

The Town of Banff has a unique context with an engaged and active community situated in Canada’s first national park and a United Nations Educational, Scientific and Cultural Organization (UNESCO) World Heritage Site. This context impacts the Land Use Bylaw Amendments and policies that can be implemented.

Amendments to the Land Use Bylaw will require three readings at Council, a public hearing, and Parks Canada sign-off for final approval. It is expected that the successful applicant will assist throughout this process and make proposed changes based on feedback at each stage.

The following deliverables are anticipated as part of the Land Use Bylaw Amendments:

• Identification of each proposed Land Use Bylaw tactic
• Overview of the purpose and objective of each tactic
• Accompanying regulatory text for inclusion in the Land Use Bylaw

The Land Use Bylaw amendments are expected to be completed by the end of Q4, 2025.
