    • ADDITIONAL FEES AND CHARGES: Vendors shall include all applicable fees, charges, surcharges, shipping/handling, delivery, or any other charges associated with this solicitation in the price submitted.
    • HAWAII GENERAL EXCISE TAX (GET): Unless otherwise stated in this solicitation, vendors shall include all applicable taxes in the price submitted. The Hawaii General Excise Tax (GET) shall not exceed 4.712% for the islands of Oahu, Kauai , Hawaii, and Maui.
    • VENDOR NON-COMPLIANCE : NON-COMPLIANCE may result in a vendor not receiving an award, delay of payment, or cancellation of award. If the vendor does not maintain timely compliance, which is the vendor’s responsibility, an offer otherwise deemed responsive and responsible may not be awarded. State agencies may check for compliance at any time.
    • TRANSACTION FEES: The awarded vendor shall pay a transaction fee of 0.75% (.0075) of the award, not to exceed $5,000 for each award. This transaction fee shall be based on the original award amount and the awarded vendor shall be responsible for payment of the fee to Tyler Hawaii, the vendor administering the HIePRO. Payment must be made to Tyler Hawaii within thirty (30) days of receipt of invoice. The invoice is generated based on the date the award is posted.
    • QUESTIONS ABOUT THIS SOLICITATION: Unless otherwise indicated, questions regarding this solicitation must be directed to the Buyer listed.
    • RESPONSE TO THIS SOLICITATION: Only responses submitted through HIePRO shall be considered for award.
    • VENDOR COMPLIANCE – PAPER DOCUMENTS : Vendors not utilizing HCE shall provide paper certificates that must be valid at the time of award. All applications for applicable clearances are the responsibility of the vendor, who must be compliant pursuant to HRS§103D-310(c) with the chapters 1) Chapter 237, General Excise Tax Laws; 2) Chapter 382, Hawaii Employment Security Law; 3)Chapter 386, Worker’s Compensation Law; 4) Chapter 392, Temporary Disability Insurance; 5)Chapter 393, Prepaid Health Care Act; and 6) §103D-310(c), Certificate of Good Standing (COGS) for entities doing business in the State.     NOTICE TO BIDDERS
    COMPETITIVE BIDS for DOASW17 shall be submitted to the State of Hawai'i, Department of
    Agriculture and Biosecurity (DAB), Agricultural Resource Management Division (ARMD)
    electronically via Hawai'i e-Procurement (HIePRO) before 2:00 p.m., April 30, 2026. Fill out this
    document and submit as an attachment on HIePRO. HIePRO is accessible through the State
    Procurement Office website at www.spo.hawaii.gov.
    General Conditions - AG-008, latest revision shall be made part of the specifications.

    CONDITION OF AWARD
    It is understood that the award of the contract will be made on the basis of the lowest responsible
    Base Bid (Items 1 to 3).
    In the event the low bid is below the available funds certified by the appropriate fiscal officer, the head of
    the purchasing agency responsible for the procurement in question is authorized to award Additives to the
    lowest bidder. The award of Additives may be in any order or combination such that the Base Bid plus
    Additives do not exceed the available funds.

    It is understood and agreed that the Department of Agriculture and Biosecurity reserves the right to reject
    any and/or all bids and waive any defects when, in the Board's opinion, such rejection or waiver will be for
    the best interest of the State of Hawaii.
    In the event all bids exceed available funds certified by the appropriate fiscal officer, the head of the
    purchasing agency responsible for the procurement in question is authorized in situations where time or
    economic considerations preclude resolicitation of work of a reduced scope to negotiate an adjustment of
    the bid price, including changes in the bid requirements, with the low responsible and responsive bidder, in
    order to bring the bid within the amount of available funds. It is understood and agreed upon that the head
    of the purchasing agency may delete a portion or all of any item(s) in the proposal at the stated unit or lump
    sum price as necessary to stay within the available funding. The bidder is responsible to make an earnest
    effort to represent the actual cost of each item, including all materials, labor, equipment, overhead and
    profit in their bid proposal to preclude claims of anticipated profit or loss of profit because of an unbalanced
    bid proposal.
    It is also understood that if a mutually agreeable cost for the reduced scope of work necessitated by a lack of
    available funds cannot be agreed upon between the bidder and the head of the purchasing agency within 14
    calendar days after the bid opening, then the bid may be rejected in the best interest of the purchasing
    agency, and the head of the purchasing agency may negotiate in progressive order (lowest to highest) with
    the next lowest responsible and responsive bidder.
    SPECIFICATIONS
    In addition to detailed equipment specifications herein, the following requirements shall form a part of
    these specifications:
    A. Equipment offered shall include any other standard features not listed but detailed in the
    manufacturer's brochures and deemed necessary for the proper and safe operation of the equipment.
    B. Manufacturer's standard warranty of 1 year from the date the equipment is placed in service. Full
    coverage shall include cost of parts, labor and any other expenses incurred in performing warranty work.
    Hard copies of warranty documents shall be delivered with the equipment and shall detail manufacturer's
    obligation and warranty.
    C. Contractor shall provide copies of the owner-operator manual and service/repair manual per each
    type of vehicle and attachment at the time the equipment is delivered. All manuals are to be complete and
    furnished with the delivery of the equipment. Hard copies of all manuals shall be delivered with the
    equipment. An electronic version of the manuals shall be submitted before or on the equipment date of
    delivery, if available. The electronic version should be printable with no material omissions.
    D. Equipment shall be completely serviced and in full operational condition upon delivery.

    E. Accessory or standard equipment installed on the vehicles shall be fully guaranteed by the
    Contractor against defects resulting from the use of defective or inferior materials or from neglect or from
    defective workmanship or against all design and manufacturing defects. Warranty period shall begin from
    the date equipment is placed in service and shall be for a minimum period of one (1) year or for the period
    guaranteed by the manufacturer, whichever is longer except for rust proofing. Hard copies of warranty
    documents shall be delivered with the equipment and shall detail manufacturer's obligation and warranty
    procedures. Contractor shall replace or repair defective material and/or workmanship at no cost to the State
    for parts and labor during the warranty period, provided such defects are not due to abuse or negligence on
    the part of the State.
    F. All equipment offered shall meet ANSI and OSHA safety requirements, and any other Federal or
    State safety requirements. If applicable or when requested, equipment shall bear a label or written
    documentation indicating approval of safety requirements from a bonafide testing laboratory.
    G. MANUALS/TECHNICAL/SERVICE BULLETINS: Successful bidder shall furnish a set of factory service
    Bulletins: manuals containing system description/service procedures; a set of service special manuals,
    service labor time, Power train control/emission diagnosis manuals, specified equipment parts books. All
    manuals are to be complete and furnished with the delivery of the equipment. Minimum one (1) hard copy
    of each shall be submitted at the time of delivery, for each vehicle. All technical and service bulletins
    pertaining to service/repair revisions and identification of new replacement parts from the equipment
    manufacturer shall be provided by the successful bidder to the Hawai'i Department of Agriculture -
    Agricultural Resource Management Section on a timely basis.
    ATV MINIMUM SPECIFICATIONS

    SPECIAL PROVISIONS
    1. INTRODUCTION
    Pursuant to 103D-305, Hawaii Revised Statutes, the State of Hawaii, Department of
    Agriculture, Agricultural Resource Management Division (hereinafter referred to as
    "ARMD") is accepting quotes for all terrain vehicles, in accordance with the following
    specification. All costs including taxes and any associated cost shall be included in the
    bid provided by the Bidder.
    2. TERMS AND ACRONYMS USED HEREIN

    3. AUTHORITY
    This IFB is issued under the provisions of the State Procurement Code (HRS
    Chapter 103D) and the State Procurement Office's applicable Directives, Circulars, and
    administrative rules. All prospective Offerors are charged with the presumptive
    knowledge of all applicable legal authorities. Submission of a valid executed offer by any
    prospective Offeror shall constitute admission of such knowledge on the part of such
    prospective Offeror. Any Agreement arising out of this offer is subject to the approval of
    the State Department of the Attorney General, as to form and to all further approvals as
    required by statutes, administrative rule, order, or other directives.

    5. BID PREPARATION
    Bid Submittal: Bids shall be submitted through HIePRO.
    NO OFFERS WILL BE ACCEPTED AFTER THE DEADLINE SET FOR
    SUBMITTING OFFERS.
    Legal Name. Offers shall be submitted using the Offeror's exact legal name as
    registered with the State Department of Commerce and Consumer Affairs.
    Offer Price. The offer price shall be the all-inclusive price to perform the services
    as specified herein. The offer price shall be the all-inclusive price and includes,
    but is not limited to, all labor, taxes, and any other costs for providing the services
    herein.
    Acceptance of offer, if any, shall be made within sixty (60) calendar days after the
    opening of offers, and the prices quoted by the Offeror shall remain firm for the
    sixty (60) day period or longer as mutually agreed upon by the Offeror and the
    State.
    6. DELIVERY DATE AND LOCATION
    The equipment shall be available for acceptance by the Agricultural Resource
    Management Division, at the locations described, by November 30, 2026. Earlier
    delivery date is preferred.
    7. PAYMENT
    Acceptance of payment for the equipment delivered will not be made with the
    inclusion of the required documents and certificates.
    Section 103-10, HRS, provides that the State shall have thirty (30) days after
    receipt of invoice for satisfactory delivery of goods or performance of the services,
    to make payment in accordance with the Purchase Order. For this reason, the
    State will reject any bid submitted with a condition requiring payment within a
    shorter period. Further, the State will reject any bid submitted with a condition

    requiring interest payments greater than that allowed by 103-10, HRS, as
    amended.
    The State will not recognize any requirement established by the Contractor and
    communicated to the State after award of the contract that requires payment
    within a shorter period or interest payment not in conformance with statute.
    The State will base payment on invoices submitted by the Contractor for
    satisfactorily completed delivery of the goods.
