NOTICE TO BIDDERS / INVITATION TO BID
INVITING INFORMAL BIDS FOR
REPAIRS, MAINTENANCE OR CONSTRUCTION SERVICES OVER $75,000 AND UP TO $220,000
AWARDED PURSUANT TO THE INFORMAL BIDDING PROCEDURES OF THE
CALIFORNIA UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT ("CUPCCAA")
Notice is hereby given that the Governing Board of the Hayward Unified School District ("District") is inviting
sealed bids to construct the following project:
26.6 Rebid Warehouse Walk-in "Freezer B" Mechanical Retrofit ("Project" or "Contract").
The Project consists of replacing the aging R-404A Refrigerant system, with a modern energy-efficient
refrigeration system using the most current refrigerant that will not be phased out.
Contractors must submit sealed bids on or before 10:00 a.m. April 15, 2026, at the Hayward Unified School District
- Purchasing Department, located at 24411 Amador St. Hayward, California 94544 at or after which time the
District will open the bids and publicly read them aloud. Any claim by a Bidder of error in its bid must be made in
compliance with Public Contract Code 5100, et seq. Any bid that is submitted after this time shall be non-
responsive and returned to the Bidder. The District is not responsible for Bids that are received after the deadline
noted above.
Contractor shall possess at the time of its bid, the following classification(s) of Contractor's California State license:
CSLB C-38 Refrigeration Contractor.
A mandatory bidders' conference will be held at 10:00 a.m. April 7, 2026, at Hayward Unified School District
Warehouse 24400 Amador St. Hayward, California 94544, for the purpose of acquainting all prospective
contractors with the bid documents and the work site.

Each bid shall be made on the Bid Form prepared by the District in the Contract Documents and must conform and
be fully responsive to all documents comprising the Contract Documents.
The successful Bidder and its subcontractors shall pay all workers on the Project not less than the general
prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as determined by
the Director of the Department of Industrial Relations, State of California, for the type of work performed and the
locality in which the work is to be performed within the boundaries of the District, pursuant to Labor Code 1770
et seq. Prevailing wage rates are on file with the District and are available to any interested party on request or at
www.dir.ca.gov/oprl/statistics_and_databases.html. Bidders and Bidders' subcontractors shall comply with the
registration and qualification requirements pursuant to Labor Code 1725.5 & 1771.1.
The successful Bidder may substitute securities for any monies withheld by the District to ensure performance
under the Contract, in accordance with the provisions of Public Contract Code 22300.
Bonds. A bid bond by an admitted surety insurer on the form provided by the District, cash, or a cashier's check or
a certified check, drawn to the order of the District, in the amount of ten percent (10%) of the total bid price, shall
accompany the Bid Form, as a guarantee that the Contractor will, within seven (7) calendar days after the Notice to
Proceed or other direction, enter into a contract with the District for the performance of the Services as stipulated
in the bid. In addition, a one hundred percent (100%) Performance Bond and a one hundred percent (100%)
Payment Bond will be required of the successful bidder.

The District's Board reserves the right to reject any and all bids and/or waive any irregularity in any bid received. If
the District awards the Contract, the security of unsuccessful Bidder(s) shall be returned within sixty (60) days from
the time the award is made. Unless otherwise required by law, no Bidder may withdraw its bid for ninety (90) days
after the date of the bid opening.

no later than 10:00 a.m. on April 9, 2026.
The Project is anticipated to commence on May 1, 2026, with completion expected within thirty (30) calendar days
from the start date.

PROJECT: 26.6 Rebid Warehouse Walk-in "Freezer B" Mechanical Retrofit This project consists of the mechanical retrofit
of "Freezer B" (38'L x 18'W x 12'H) by decommissioning the aging R-404A refrigeration system and replacing it with a high-
efficiency, sustainable solution utilizing a non-phase-out refrigerant compliant with current environmental regulations. The
contractor is responsible for field-verifying all dimensions and cooling load requirements for the approximate 8,208 ft3
space before installing new condensing units, evaporator coils, and digital controls, including a new thermostat and defrost
timer-connected to the existing electrical disconnect. The installation will feature new ACR copper piping with insulated
suction lines, along with a new drain line equipped with a proper trap and heat tape to prevent freezing. To ensure optimal
thermal integrity, all door gaskets will be renewed to provide an airtight seal. All work must be executed in a professional,
workmanlike manner within a 2-to-4-week window, including the environmentally responsible disposal of all retired
equipment and the proper reclamation of legacy refrigerants. As fully described in Exhibit A - Scope of Work.
("Project" or "Contract")
1. Bid. Contractor will perform the work defined in the Contract Documents and fully understands the Scope of Work
required in this bid and accepts in full payment for that Work the following total lump sum amount, all taxes included:

required in this bid, understands the construction and project management function(s) described in the Contract

3. Schedule. Contractor agrees to commence work under this Contract on the date established in the Contract
Documents and to complete all Work within the time specified in the Contract Documents.
4. Subcontractors. Contractor shall provide the following for each subcontractor that will perform work or labor or
render service in or about the construction of the Work or improvement in an amount in excess of one-half of 1
percent (0.5%) of the Contractor's total bid. Use extra sheets/extra space as needed. The District may, in its sole
discretion, find Contractor's Bid non-responsive if Contractor fails to include all the information identified below.

than ten percent (10%) of the bid amount. The certified or cashier's check or bid bond shall be made payable to the
order of the District. If a bid bond accompanies the bid/proposal, the bond shall be secured by an admitted surety
company, licensed in the State of California, satisfactory to the District and in the form attached hereto. The certified
or cashier's check or bond shall be given as a guarantee that Contractor will enter into the Contract if awarded the
Work, and in the case of refusal or failure to enter into the Contract, the District shall have the right to award to
another bidder. If Contractor fails or refuses to timely enter into the Contract, the District reserves the right to declare
the bid bond forfeited and to pursue all other remedies in law or equity relating to such breach including, but not
limited to, seeking recovery of damages for breach of contract. Failure to provide bid security, or bid security in the
proper amount, will result in rejection of the bid.
6. Noncollusion Declaration. Contractor shall provide with its bid the Noncollusion Declaration in the form attached
hereto.
7. License. Contractor certifies that it is, at the time of bidding, and shall be throughout the period of the Contract,
licensed by the State of California to do the type of Work required under the terms of the Contract Documents.
Contractor further certifies that it is regularly engaged in the general class and type of work called for in the Contract
Documents.
8. Prevailing Wages. Pursuant to sections 1770 et seq. of the California Labor Code, Contractor and all Subcontractors
under the Contractor shall pay all workers on all work performed pursuant to the Contract not less than the general
prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as determined by the
Director of the State of California Department of Industrial Relations ("DIR") for the type of work performed and the
locality in which the work is to be performed within the boundaries of the District. Copies of the general prevailing
rates of per diem wages for each craft, classification, or type of worker needed to execute the Contract, as determined
by the DIR are on file and available from the District at the District's office or on the internet (http://www. dir.ca.gov).
In addition, if awarded a contract, Contractor shall comply with Labor Code 1777.5 pertaining to prevailing wage
compensation to apprentices for preemployment activities.
9. Contractor Registration. Contractor shall ensure that it and its Subcontractors comply with the registration and
compliance monitoring provisions of Labor Code section 1771.4, including furnishing its Certified Payroll Reports
("CPR") to the Labor Commissioner, and are registered pursuant to Labor Code section 1725.5. Contractor and its
subcontractors shall comply with Labor Code section 1725.5 to be qualified to bid, be listed in a bid or proposal, subject
to the requirements of Section 4104 of the Public Contract Code or engage in the performance of the Contract.
10. Bid Protests. Any bid protest by any Contractor regarding any other bid on this Project must be submitted in writing to
the District to Purchasing Manager, 24411 Amador St Hayward, Ca 94544, at before 5:00 P.M. of the SECOND (2ND)
business day following the date of bid opening, or the Contractor waives its right to protest. The protest must contain a
complete statement of any and all bases for the protest and the Contractor must concurrently transmit a copy of the
protest to all other bidders that appear to have a reasonable prospect of receiving an award depending upon the
outcome of the protest.
