NOTICE TO BIDDERS

Sealed Proposals will be received by the City of Tampa no later than 1:30 P.M., Aug ust 2 5,
2026 , in the 4th Floor Conference Room, Tampa Municipal Office Buildi ng, 306 E. Jackson Street,
Tampa, Florida, ther e to b e publ icly opened and read aloud.
The proposed work is to include, but not be limited to, construction of new sidewalk segments, repair
and replacement of existing sidewalks, retrofitting existing
sidewalks and ramps to meet ADA requirements at various locations throughout the City of Tampa as
described in individual work orders with all associated work required for a complete project
in accordance wi th th e Contra ct Document s.

Florida 33602.
Each Proposa l must be sub mitte d o n the Proposal for m includ ed in th e Spe cifications a nd must
be ac companied by a c ertified check or cashier's check on a s olvent bank or tru st c ompany in
comp liance w ith S ec t ion 255.051, Flo rida S tatutes, made payable to the City of T ampa , i n an
amount of not less than five per cen t of the total bid, or a Bid Bond , of like amount, on the form set
forth in t he Co ntract D o cumen ts, as a guara ntee that, if the Proposal is a ccepte d, the Bid der will
execut e the Propo sed Contract and furnish a Public Construction Bond within twenty (20) days
after receipt of Notice of Award of Contract.
To be eligible to submit a p roposal, a Bidder must hold the required and/or ap pro priat e current
license, certific ate, or r egis tration (e.g. DBPR license/certificate of authorization, e tc. ) in good
standing at the time of receipt of Bids. P er Sect ion 489.131, Flo rida Statutes, Pro posals submitted for
the construction, improvement, remodeling, or repair of public projects must be accompanied by
evidence that the

Bidder holds the required and/or appropriate current certificate or registration, unless the work to be
performed is exempt under Section 489.103, Florida Statutes.
The City of Tampa reserves the right to reject any or a ll B ids and t o w aive a ny informalities in t he B id
and/or Bid Bond. Acceptance or rejection of P roposals will be made as s oon a s p racticable after th e
Proposals are received, but the City reserves the right to hold P roposals f or n inety ( 90) days f rom t he
date of Opening.
Bid Protest Procedures: Unless subsequently indicated otherwise, in a revised posting on the
Department's web page for Construction Project Bidding, the City of Tampa intends to award the
referenced project to the lowest bidder listed in the tabulation posted on or about the date of
Bid Openin g. A bid der aggrie ved by this decis ion may fil e a prot est not la ter t han 4 :30 P.M.,
five (5) busine ss da ys fr om t he first posting thereof, p urs uant to City of Tamp a Code C ha pter 2,
Article V, Division 3 , Sectio n 2-282, Proc uremen t Protest Pro cedures. Pro tests not conforming
therew ith shall no t be reviewed.
Pursuant to Section 2-282, City of Tampa Code, during the solicitation period, including any protest
and/or appeal, NO CONTACT with City officers or employees is permitted from any bidder or
proposer, other than as specifically stated in this solicitation and as follows: Director of the Contract
Administration Department (CAD); Contracts Management Supervisor, Jim Greiner; City legal
department.

in Section 287.017, for CATEGORY TWO for a period of 36 months from the date of being placed on the
convicted vendor list." Refer to Section 287.133, Florida Statues.
Pursuant to Section 287.087, Florida Statutes, under certain circumstances preference may be given to
businesses with a drug-free workplace program that meets the requirements of said Section.

INSTRUCTIONS TO BIDDERS
SECTION 1 - SPECIAL INSTRUCTIONS
I-1.01 GENERAL:
The proposed work is the Citywide Sidewalk Maintenance - Sheltered Marke t FY26 in the City o f
Tampa, as r equ ired for a complete pro ject, as shown on th e pl ans and d et aile d in the specific ations.
The work is lo cate d on lan d owned or c ontroll ed b y the City o f Tampa.
To be eligible to submit a proposal, a Bidder must hold the required and/or appropriate curren t
license, certificate, or regi stration (e.g. DBPR license/cer tificate of authorizatio n, etc.) in good
stand ing at the tim e of rece ipt of Bids. Per Section 489.131, Florida Statutes, Prop osa ls submitted for
the constructio n, improvemen t, remode ling, or repair o f pub lic projects must be accompanied by
eviden ce that the Bidder holds th e required and/or ap propriate current certificate or registration ,
unless the w ork to be perfo rmed is exempt under Section 489 .103, Florida Statutes.
I-1.02 FORM PREPARATION AND PRESENTATION OF PROPOSALS: Replace the second sentence with
the following: Submission of the entire specification book is not required.
I-1.03 ADDENDA - Section I-2.03 is replaced with the following: No interpretation of the meaning
of the Plans, Specifications, or other Contract Documents will be made to any Bidder orally.
Every request for such interpretation must be in writing, addressed to the City of Tampa, Contract
Administration Department, 306 E. Jackson St., 4th F loor, T ampa, Florida 3 3602 and t hen e mailed to
ContractAdministration@tampagov.net. To be given consideration, such request m ust b e received a t
least seven (7) days prior to the date fixed for the opening of the Proposals. Any and all such
interpretations and any supplemental instructions will be in the form of written addenda which, if
issued, will be posted on the Department's web page. F ailure of any Bidder t o r eceive a ny s uch
addenda shall not relieve said Bidder from any obligation under his Proposal as submitted . All
addenda so iss ued shall bec om e pa rt of the Contract Do cuments.

I-1.04 INSTRUCTIONS TO BIDDERS
SECTION 2 - GENERAL INSTRUCTIONS. Section I-2.07 SIGNATURE AND QUALIFICATIONS OF BIDDERS is
replaced with the following:
Proposals must be signed in ink by the Bidder with signature in full. When firm is a Bidder, the
Proposal shall be signed in the name of the firm by one or more partners. When a corporation
is a bidder the officer signing shall set out the corporate name in full beneath which he shall
sign his name and give the title of his office.
If the bidder referred to in Section I-2.07 is a corporation, it must submit; upon request, a copy
of its filed Articles of Incorporation. In addition, if the bidder was incorporated in another state,
it must establish that it is authorized to do business in the State of Florida. If the bidder is using
a fictitious name, it must submit upon request, proof of registration of such name with the Clerk
of the Circuit Court of the County where its principal place of business is. Failure to submit what
is required is grounds to reject the bid of that bidder.
SECTION 2 - GENERAL INSTRUCTIONS. Section I-2.14 NONDISCRIMINATION IN EMPLOYMENT is
changed to add the following to the end of the existing text:
The following provisions are hereby incorporated into any contract executed by or on behalf of the
City. Contractor shall comply with the following Statement of Assurance: During the performance of
the Contract, the Contractor assures the City, that the Contractor is in compliance with Title VII of the
1964 Civil Rights Act, as amended, the Florida Civil Rights Act of 1992, and the City of Tampa Code of
Ordinances, Chapter 12, in that Firm/Contractor does not on the grounds of race, color, national origin,
religion, sex, sexual orientation, gender identity or expression, age, disability, familial status, or marital
status, discriminate in any form or manner against said Firm's/Contractor's employees or applicants
for employment. Contractor understands and agrees that the Contract is conditioned upon the veracity
of this Statement of Assurance, and that violation of this condition shall be considered a material
breach of the Award/Contract. Furthermore, Contractor herein assures the City that said Contractor
will comply with Title VI of the Civil Rights Act of 1964 when federal grant(s) is/are involved. This
Statement of Assurance shall be interpreted to include Vietnam-Era Veterans and Disabled Veterans
within its protective range of applicability. Firm/Contractor further acknowledges and agrees to

provide the City with all information and documentation that may be requested by the City from time
to time regarding the solicitation, selection, treatment and payment of subcontractors, suppliers and
vendors in connection with this Award/Contract. Firm/Contractor further acknowledges that it must
comply with City of Tampa Code of Ordinances, Chapter 26.5.
I-1.05 TIME FOR COMPLETION:
The work shall be arranged to be completed in accordance with a progress schedule approved by the
Construction Engineer.
The time for completion of this project, referred in Article 4.01 of the Agreement, shall be 365
consecutive calendar days. The period for performance shall start from the date indicated in the Notice
To Proceed.
I-1.06 LIQUIDATED DAMAGES:
The amount of liquidated damages, referred to in Article 4.06 of the Agreement, for completion of this
project shall be $500 per calendar day.
I-1.07 BASIS OF AWARD OF CONTRACT:
The basis of award referred to in Item I-2.11 of Instructions to Bidders shall be the greatest amount of
work, which can be accomplished within the funds available as budgeted. The award may be made on
the basis of the total bid, base bid, alternates(s) if any, unit bids if any, or any combination thereof
deemed to be in the best interest of the City.
Unless all bids are rejected, the award will be made within 90 days after opening proposals.
Contract can be renewed for three (3) additional one (1) year period at the same prices, terms and
conditions, if agreeable to both parties and if funds are available. To renew the contract for an
additional one (1) year period the Contractor must notify the City, in writing, that it desires renewal of
the contract. The letter must be received by the City at least 120 days prior to contract expiration. The
City shall respond to the Contractor's renewal request at least 90 days prior to the contract expiration.
The City may, at its option, award to more than one bidder.

I-1.08 GROUND BREAKING CEREMONY:
Arrangement may be made by the City in coordination with the Contractor, for construction to
commence with a Ground Breaking Ceremony. Details will be discussed at the pre-construction
conference.
I-1.09 INSURANCE:
The insurance required for this project shall be as indicated on the attached and incorporated Special
Instructions pages beginning with page INS-1 entitled CITY OF TAMPA INSURANCE REQUIREMENTS,
which among other things requires the Contractor to provide a Certificate of Insurance to the City prior
to commencing work. The City may from time to time use a third-party vendor to manage its insurance
certificates and related documentation which vendor may periodically initiate contact, requests for
information, etc. on the City's behalf.
I-1.10 TESTING:
The Contractor shall perform all Quality Control (QC) testing to meet the FDOT requirements in the
Florida Department of Transportation, JULY 2022 Standard Specifications for Road and Bridge
Construction.
I-1.11 EQUAL BUSINESS OPPORTUNITY PROGRAM REQUIREMENTS

I-1.12 BID SECURITY:
Surety companies shall have a rating of not less than B+ Class VI as evaluated in the most recently
circulated Best KeyRating Guide Property/Casualty.
I-1.13 PUBLIC CONSTRUCTION BOND:
The Bidder who is awarded the Contract w ill be r equired t o f urnish a Public C onstruction B ond u pon
the form provided herein, equal to 100 percent of the Contract price, such Bond to be issued and
executed by (a) surety company(ies) acceptable to the City and licensed to underwrite contracts in
the St at e of Flori da. A fter execu tio n of the Agreem ent and be fore commencing work, the Contra ctor
must pr ovide the City a cer tified co py of the officially reco rded B ond.
I-1.14 AGREEMENT
SECTION 2 - POWERS OF THE CITY'S REPRESENTATIVES - Add the following:
Article 2.05 CITY'S TERMINATION FOR CONVENIENCE:
The City may, at any time, terminate the Contract in whole or i n p art f or t he C ity's c onvenience and
without cause. Termination by the City under this Article shall be by a notice of termination delivered
to the Contractor, specify the extent of termination and the effective date.
Upon receipt of a notice of termination, the Contractor shall immediately, in accordance
with instruc tions from the City, pro ceed with performance o f the follo wing d uties regar dle ss of
delay in determ ining or a djusting a mounts du e un der this Pa ragraph:
(a) cease operations as specified in the notice;
(b) place no further orders and enter into no further subcontracts for materials, labor,
services or facilities except as necessary to complete continued portions of the Contract;
(c) terminate all subcontracts and orders to the extent they relate to the Work terminated;
(d) proceed to complete the performance of Work not terminated; and
