NOTICE TO BIDDERS

Gaston County is seeking competitive bids for the purchase and installation of twin Yamaha motors.

Sealed bids will be received by Gaston County’s Public Works – Fleet Services Department, 323 N. Avon Street, Gastonia, NC 28054 until 03:00 P.M. Eastern Time, Monday, March 11, 2026, at which time bids will be publicly opened and read out loud for the furnishing of the following:

Purchase and installation of twin Yamaha 250 outboard motors onto a 2014, 27’, Workskiff, Force Protect. This should include all necessary wiring harnesses, displays and controller assemblies, as well as labor. Additionally, this should include the Helm Master, JoyStick and Auto Pilot. The boat currently has twin Yamaha 250 motors on it, that were original to the vessel.

Mailed sealed bids will be received by Gaston County, NC in the office of Gaston County Public Works – Fleet Services Attn: Wilson Lemly, 323 N. Avon Street, Gastonia, NC 28054. It is the responsibility of the bidder to ensure receipt of the mailed sealed bid prior to the opening of the bid. No bid shall be considered if received after the deadline.

Hand delivered sealed bids on bid day will be received at 323 N. Avon Street Gastonia, NC 28054 until 3:00 P.M Eastern Time on Monday, March 11, 2026.

No bid shall be withdrawn after the opening of bids without the consent of Gaston County, for a period of sixty (60) days after the scheduled time of bid closing.

The award of contract will be made by Gaston, County, North Carolina, to the lowest responsive, responsible bidder whose quote, taking into consideration quality, performance, and delivery time specified, conforms to the specifications, and is deemed to be the best value in the opinion of Gaston County.

Gaston County reserves the right to reject any bid for failure to comply with all requirements of this notice or of any of the contract documents; however, it may waive any minor defects or informalities at its discretion. Gaston County further reserves the right to reject all bids or award a contract which, in its judgment, is in the best interest of the County.


General Terms and Conditions

1. General:
All bids are subject to the provisions of the attached General Contract Terms and Conditions. All bid responses will be controlled by the Terms and Conditions included by Gaston County.

Pursuant to G.S. 143-48 and Executive Order No. 77, the County invites and encourages participation in this procurement by minority and women owned businesses.

2. Bid Deposit and Performance Bond
There is NO bid deposit or performance bond required for this bid event.

3. Pre-Bid Meeting
There will NOT be a pre-bid meeting for this event.

4. Bid Submission Instructions
Mail one fully executed bid document, unless otherwise instructed, and only one bid per envelope. Address envelope and insert bid number as shown below. It is the responsibility of the bidder to have the bid delivered by the specified time and date of opening.

Caution to Offerors: If sending via USPS (including priority mail, express, etc) – Gaston County picks up mail at Post Office at 6AM.  Consider this when arranging shipment since submittals reaching the Post Office after 6AM on the due date, will not reach Issuing Agency by the submittal deadline.

5. Addendums
Bidders are responsible for checking for any addendums prior to completion and submission of bid. Addendums, if any, will be posted online at https://www.gastongov.com/Bids.aspx. Addendum acknowledgement and requirements, if any, must be included with submission of bid.

6. Deviations
Any deviations from specifications and requirements herein must be approved by Gaston County prior to bid submittal. Otherwise, it will be considered that equipment or goods offered are in strict compliance with the specifications and requirements herein.

7. Warranty
Equipment shall be new and shall be guaranteed against defect in materials, workmanship and performance in accordance with the manufacturer's standard warranty. Warranty coverage shall begin on the date of acceptance by Gaston County.

8. Use of Bid Form
Bids must be submitted on the forms provided herein. Bids submitted in any other format will not be accepted. If additional sheets are required, the bidder should make necessary copies and insert them in the bid document.

9. Award Criteria
As provided by Statute, award will be based on the lowest and best bid(s) most advantageous to Gaston County as determined by consideration of:

a. Price

b. Quality of product(s) offered

c. General reputation and performance capabilities of bidder

d. Proven performance of equipment or goods offered

e. Conformity with intent of specifications herein

f. Bidder’s previous performance in contract with the County

g. Conformity with the terms and conditions of this Invitation to Bid

h. Adequate availability of service and parts

i. Delivery
Bids shall be evaluated using the Total Bid. The Total Bid shall be the summation of the product of all of the Item(s) Unit Price(s) by their Estimated Quantities. In the event of a math error, the Extended Totals and the Total Bid will be corrected based on the Unit Price furnished in the Bid. Bids with math errors will be compared using the corrected Total Bid (i.e. the math must be correct before a quote is considered for award).

10. Award of Contract
It is the general intent to award this contract to a single overall bidder on all items. The right is reserved; however, to make awards on the basis of individual items or group of items, if such shall be considered by the County to be most advantageous or to constitute its best interest.

11. Exclusion of Taxes from Quotes
The bidder shall exclude sales tax from their bid. The County pays sales tax and will add this to the bid separately when invoices are paid.

12. Acceptance and Payment
Payment will normally be made by check within thirty (30) days after acceptance by the County of the products as being provided in complete accordance with the specifications and after invoicing.

13. Acceptance Period
Bids shall be binding for a period of ninety (90) days.

ADDITIONAL CONTRACT TERMS/CONDITIONS AND SIGNATURE PAGE

1. NON-APPROPRIATION

In the event funds are not appropriated during the term of this Agreement for the subject matter herein described, and there are no other available funds by or with which payment can be made, this Agreement is terminated. This Agreement will be deemed terminated on the last day of the fiscal period for which appropriations were received without penalty or expense, except to the portion of payment for which funds have been appropriated and budgeted.

2. DIVESTMENT ACTS

The undersigned certifies that it is not designated as a company engaged in the boycott of Israel by the State Treasurer nor is the company on the Final Divestment List (Iran Divestment Act) created by the State Treasurer pursuant to Chapter 147 of the North Carolina General Statutes.

3. NORTH CAROLINA E-VERIFY CERTIFICATION

By signing and entering into this Agreement with Gaston County, pursuant to Article 2 of Chapter 64 of the N.C. General Statutes, I hereby certify that I comply with E-Verify, the Federal program used to verify the work authorization of newly hired employees working in North Carolina. If applicable, I am also certifying that any subcontractor hired or used by me will comply with E-Verify, as described herein.

4. ADA AND CIVIL RIGHTS CERTIFICATION OF COMPLIANCE

I hereby certify that I comply with all applicable federal civil rights laws, including the applicable provisions of the Americans with Disabilities Act.

5. RIGHT FOR COUNTY TO AUDIT

During the term of this Agreement and for one (1) year after termination, the County shall have the right to audit, internally or through an independent auditor, all books and records pertaining to this Agreement of the vendor as needed to evaluate the vendor’s compliance with the terms and conditions of the Agreement or a party’s payment obligations. The County shall pay its own expenses for such audit but shall not pay any expenses or additional costs of the vendor associated with such audit. However, such expenses shall be paid to the County if the audit reveals noncompliance that would have cost the County excess of $10,000 but for the audit. The County has the right to seek remittance for overpayment arising from the vendors’ non-compliance or irregularities with the performance of the Agreement. Specific audit provisions established in the Agreement will supersede this paragraph.
