The Food and Drug Administration (FDA) intends to award contracts to governmental agencies within the: 1) Territory of American Samoa; 2) State of California; 3) State of Illinois; 4) State of Michigan; 5) State of Minnesota; 6) Territory of Northern Mariana Islands; 7) State of New Jersey; 8) State of Pennsylvania; 9) State of Washington; and, 10) State of Wisconsin, to assist in inspecting retail establishments that sell cigarettes and/or smokeless tobacco products and in surveillance of other entities that fall under the scope of the Tobacco Control Act and the provisions that will be cited in the request for proposal (RFP). All interested parties must be an agency or subdivision of a state, territory, local, or tribal government that has the power to create, enforce, or administer rules or policies that govern the conduct of individuals or other private entities such as small businesses.
The proposed contract action is for services for which the Government intends to solicit and negotiate with ONLY state organizations under the authority of 41 U.S.C. 3304(a)(5). This notice is issued for informational purposes and is not a request for competitive proposals. Any interested party should respond with a statement of your intent to submit a proposal in response to the NOI-FDA-2025-75F40125R00034 RFP. Any interested party shall submit a capabilities statement and/or a statement of intent to include a description of your legal authority, organizational capability, and staffing capacity to conduct tobacco compliance check inspections, a point of contact, official agency name, address, and valid Unique Entity ID number. It shall not exceed 5 double spaced pages.
It is estimated that the solicitation will be available on or about mid-March 2025 on the System for Award Management website at www.sam.gov. It is the offerors responsibility to monitor the System for Award Management website for the release of the solicitation and amendments. Responses to this notice must be sent via e-mail to Pamela T. Lee at Pamela.Lee@fda.hhs.gov by February 25, 2025, at 10:00 AM Eastern Time.
