1. INSTRUCTION TO BIDDER
1.1. To obtain specifications or bid packet, information for this Solicitation, information can be downloaded at the
McLennan County website; Link: https://www.co.mclennan.tx.us/Bids.aspx or by contacting, Tim Cubos, Contract
Administrator, by phone at 254.757.5016 or by email at Tim.Cubos@mclennan.gov.
1.2. It is the Bidder’s responsibility to check the McLennan County website, frequently for any possible updates or
Addenda/Amendments that may be issued. Link: https://www.co.mclennan.tx.us/Bids.aspx
1.3. Bidder may submit general/clarification questions by Thursday, February 19, 2026, 5:00pm CST, concerning
contract or bid specifications or requirements to the Contract Administrator’ email. Vendors are encouraged to submit
your questions as soon as possible to allow adequate time for answers and any issues that may arise.
2. SUBMISSION OF BID
2.1. Sealed bids shall be received by the McLennan County Purchasing Department prior to closing date and time
Thursday, March 5, 2026; 2:00 PM (CST)
2.2. Late bid(s) or bid(s) not received by closing date and time shall NOT be considered. McLennan County is not
responsible for the lateness of mail carrier, weather conditions, etc.
2.3. Emailed or faxed bid response(s) shall NOT be accepted.
2.4. Bids shall be received, in a sealed envelope, box or container, at the address below, clearly and plainly marked:

2.5. Submittal(s) should contain one (1) original bid response and one (1) duplicate/copy of the bid response.
The original and copy can be in the same envelope, box or container and should be clearly marked as “Original”
and “Copy”.
2.6. Bid opening will take place in the Purchasing Department, 214 N. 5th Street, Waco, TX 76701, Thursday, March 5,
2026, following 2:00 PM (CST) closing date and time at which time bids will be opened and read aloud.
2.7. Bid Withdrawal, Bid Change and Alternate Bid
a. Bidders may withdraw Bid(s) at any time prior to the official opening.
b. To guarantee the authenticity of the change, responding bidder, shall initial alterations made prior to bid
opening date and time.
c. After the official opening, bids may not be amended or altered and may not be withdrawn without the approval
of Commissioners Court.
d. McLennan County reserves the right to accept or reject, in part or in whole, any bids submitted; and to waive
any technicalities, informalities or defects if deemed in the best interest of the County.
2.8. Scanned or Re-typed Response: If, in its response, the responding bidder, either electronically scans, re-types,
or in some way reproduces the County’s published bid package, then in the event of any conflict between the terms
and provisions of the County’s published bid package, or any portion thereof, and the terms and provisions of the
response made by the Bidder, the County’s bid package as published shall control. Furthermore, if an alteration of
any kind to the County’s published bid package is only discovered after the contract is executed and is or in not being
performed, the contract is subject to immediate cancellation.
2.9. No Commitment by McLennan County: This Invitation to Bid, does not commit McLennan County, to award any
contact, or to pay any costs associated or incurred in the preparation and response to this bid, to procure or contract
for the requested good(s) and/or service(s).

3. GENERAL PROVISIONS
3.1. In accordance with Texas Local Government Code 262.027(e), McLennan County Commissioners Court, may award
contracts for the purchase of road construction material to more than one bidder if each of the selected bidders
submits the lowest and best bid for a particular location or type of material.

3.2. The period for acceptance of this Bid will be thirty (30) calendar days unless the bidder notes a different period for
McLennan County Commissioners Court, approval.
3.3. Exceptions: Bid speaks for itself. Bidders who are taking exception to any terms, conditions, requirements or
specifications of this bid, shall clearly state in writing such exception(s) and should be included where indicated in
subsection 7.15. McLennan County will be the sole judge of the acceptability of any exception noted, and is not
bound to consider any bid submitted with exceptions.
3.4. Alternates: Trade names are used solely for the purpose of setting minimum standards of quality and performance
and are not to be construed as exclusionary. Bidders are encouraged to contact the McLennan County Purchasing
Department, Contract Administrator, prior to the bid opening for the purpose of clarifying specifications.
3.5. Evaluation Criteria: The bid award will be based on, but not limited to, the following factors:
a.
Response to bid specification.
b.
Vendor, experience, reputation and ability to perform requested goods and/or services.
c.
Vendor’s past performance record/past relationship with the County.
d.
Location/availability of materials and
e.
Price/Cost.
f.
Lead Time for request.
4. CONTRACT SPECIFICATIONS and REQUIREMENTS
4.1. McLennan County may purchase Type B, Type C, Type D Aggregate Surface Treatment and Concrete Sand,
loaded in county trucks at the bidder’s plant, delivered to McLennan County Precinct(s) or various location(s) within
McLennan County, according to this bid specification. Prior to award, a sample of product(s) may be required by
McLennan County, for review and testing.
4.2.
Specification: Aggregate Surface Material(s), shall meet Texas Department of Highways and Public Transportation
Latest Edition Standard Specifications for Construction of Highways, Streets and Bridges” Item No.

4.4. Concrete Sand (Fine Aggregate): Clean, hard, durable particles of natural, manufactured sand, recycled crushed
hydraulic cement concrete, slag, lightweight aggregate, or a combination thereof. Provide fine aggregate free from
frozen material and from injurious amounts of salt, alkali, vegetable matter, or other objectionable material.
4.5. Substitution(s): Any catalog number, brand name or manufacturer’s reference used is considered to be descriptive
not restrictive and is indicative of the type and quality the County desires to purchase. Bids on similar items of like
quality shall be considered if the bid is properly noted and a full description is enclosed. If a notation of substitution
is not made, it is assumed that the vendor is bidding the specified item.
4.6. Equipment: Vendor shall provide machinery, tools, and equipment necessary for proper execution of pick-up
orders, to be loaded on McLennan County truck(s) and/or trailer(s) and/or delivered orders.
4.7. Testing: If the materials and loading thereof are inspected by a commercial testing laboratory, the same will be
designated by, and at the expense of the County.
4.8. Rejection of Material: McLennan County reserves the right to reject material that, in the County’s opinion,
contains excessive fines, dust, clay-like particles or other deleterious material.
4.9. Delivery/Pick-Up (loading)
a. Loading and/or delivery of materials will be only “as needed”.
b. An approximate twelve (12) hour advanced notice may be given, prior to an order pick-up or delivery.
c. Delivery may be required to any point within McLennan County.
4.10.
Delivery/Pick-Up (loading) Ticket
a. A loading/delivery ticket shall accompany each load or delivery with the below information:

b. Description of the material delivered to include:

c. Completed orders are to be delivered to requesting departments in accordance with these bid specifications
and requirement. An authorized McLennan County Employee in the receiving department shall sign all
packing/delivery slips.

Net Pricing: The total price charge for the requested goods and/or services, after considering any added
or subtracted amount, to include but not limited to discounts.
Price and Cost response shall include all expenses, to include but not limited to, any freight or “make ready”
charges and pick-up or delivery to all McLennan County Road and bridge precinct(s) or designated jobsite
location(s) throughout McLennan County.
McLennan County is exempt from taxes, therefore taxes shall not be included in the bid price and cost
submitted.
Quantities: All quantities listed throughout this bid are estimated quantities only and are not binding
quantities for McLennan County.
Contingencies: The County shall hold the successful bidder to bid pricing, in response to this bid.
Additional charges for contingencies discovered by the vendor at any time after the date of opening of this
bid will not be considered for payment by the County.
Prices should remain effective until March 31, 2027.
