NOTICE TO CONTRACTORS
Sealed bids for Tunica County Project CO72(57), will be received by the Tunica County Board of
Supervisors at the office of the Tunica County Chancery Clerk located within the Tunica County
Courthouse (1300 School Street, Tunica, MS, 38676) until 2:00 p.m. on April 27, 2026, at which time
the bids will be opened and read aloud. Bidding documents may be inspected in the office of the Tunica
County Chancery Clerk and at the office of the Engineer, Andrew Richardson, at 231 West Center
Street, Hernando, MS, 38632 during normal business hours.
Copies of the construction plans and contract documents may be obtained at the office of the project
engineer upon payment of $60.00 for each set of documents with no refund.
In the event the bids should run over $50,000.00, the bidder shall comply with the Mississippi State law
with respect to having a Certificate of Responsibility issued by the Mississippi State Board of Public
Contractors.
All bids must be submitted in a sealed envelope with labeling that clearly states the date the bid is to be
opened, the project that is being bid upon, the Contractor’s name and address, and the Contractor's
Certificate of Responsibility Number as issued by the Mississippi State Board of Contractors or a
statement signifying that the enclosed bid is not in excess of $50,000.00.

NOTICE TO CONTRACTORS
CONTRACT TIME:
BASIS OF AWARD
20 WORKING DAYS
The award, if made, will be made to the lowest and best bid based on the published quantities for
the project. The award will be made as a whole to one bidder. Bids will only be accepted under the
name of the Bidder to whom contract documents and construction plans were issued and whose
name appears on the official List of Planholders, which will be maintained by the Engineer of
Record.
The Bidder’s contract designation as issued by the Mississippi State Board of Contractors must
coincide with the type of project being bid upon.
The attention of the BIDDER is directed to the State and Federal laws governing selection of and
employment of labor.
Contract documents and specifications are on file at the office of the Tunica County Chancery
Clerk and the Project Engineer's office. This project shall be constructed in accordance with the
latest edition of the Mississippi Standard Specifications for State Aid Road and Bridge
Construction.
Construction plans and contract documents may be secured from Andrew Richardson, Engineer of
Record, at the Engineer’s office at 231 West Center Street, Hernando, Mississippi 38632. The cost
is sixty dollars ($60.00) for construction plans and contract documents and is non-refundable.
Each bid must be accompanied by a Bid Bond payable to the Tunica County Board of Supervisors
for five percent (5%) of the total amount of the Bid and have as a surety thereon a Surety company
currently authorized and licensed to conduct business within the State of Mississippi. Bid Bonds
shall be executed by a Mississippi agent or a qualified non-resident agent. The said agent shall be
in good standing and currently licensed by the Insurance Commissioner of the State to represent
Surety companies. A certified check may be used in lieu of a Bid Bond.
A Performance Bond and a Payment Bond, each in the amount of 100% of the contract price, with
a corporate surety listed on the Treasury Department’s most current list, approved by Tunica
County, will be required for the faithful performance of the contract.
Attorneys-in-fact who sign the Bid Bond or Performance Bond and Payment Bond must file with
each Bond a certified and effective dated copy of their Power of Attorney.
Bidders are hereby notified that any proposal accompanied by letters qualifying in any manner the
condition under which the proposal is tendered will be considered an irregular bid and such
proposal will not be considered in making the award.
ALL BIDS must be made on the required bid proposal form with all Addenda acknowledged. All
blank spaces for bid prices must be filled in, in ink or typewritten, and the bid form must be fully
completed and executed when submitted. Only one copy of the BID PROPOSAL form is required.
All unit prices in the BID PROPOSAL shall be firm prices for the duration of the project, or until
such time as all work has been completed.
When a non-resident contractor submits a Bid for a Mississippi public project, he/she shall submit
with the Bid a copy of his/her resident State’s current law pertaining to such State’s treatment of
non-resident contractors as required by House Bill Number 850, Chapter Number 527, Laws of
1988. Bidders residing in a state having no contractor preference law shall so state in a letter on
the contractor’s letterhead with the submitted Bid.
The Tunica County Board of Supervisors may waive any informalities or minor defects or reject any
or all bids. Any bid may be withdrawn prior to the scheduled time for the opening of bids or
authorized postponement thereof. Any bid received after the time and date specified shall not be
considered.
Bidders must satisfy themselves of the accuracy of the estimated quantities in the bid schedule by
examination of the site and a review of the drawings and the specifications, including addenda.
After bids have been submitted, the bidder shall not assert that there was a misunderstanding
concerning the quantities of work or of the nature of the work to be done. Work on this project is to
be paid out by the unit price that is bid. The estimated item quantities set out in the Bid Form are
not guaranteed and are solely for the purpose of comparing Bids. Payment will be made on the
actual quantity of each item installed and accepted. It is understood that the quantities of items
may be increased or decreased for which payment will be made at the unit price bid. It is also
understood that the location of some work items may be changed from that shown on the
construction plans and such change in location shall be made at the unit price bid for the various
items involved.
Tunica County hereby notifies all Bidders that it will affirmatively insure that disadvantaged and
woman owned business enterprises will be afforded the full opportunity to submit bids in response
to this invitation. When considering the award of any contract resulting from this invitation, the
Tunica County Board of Supervisors will not discriminate against any bidder on the grounds of
race, gender, or national origin.
Any contract or contracts awarded under this invitation for bids are expected to be funded under
the provisions of House Bill 603 (2023 Mississippi Regular Legislative Session). Neither the State
of Mississippi nor any of their employees is or will be a party to this invitation for bids or any
resulting or related contracts. This procurement will be subject to all applicable section of the
Mississippi Code of 1972, as amended as they apply to local governments, in accordance with the
referenced House Bills and in accordance with the executed Memorandum of Understanding
between the Mississippi Department of Finance and Administration and Tunica County (executed
by The Tunica County Board of Supervisors on August 22, 2023). Based on House Bill 1707, the
following shall be incorporated into any contract for the work/projects: Uniform Administrative
Requirements, Cost Principles, and Audit Requirements for Federal Awards Subpart D Post
Federal Award Requirements Procurement Standards, in accordance with 2 CFP 200.317 through
2 CFR 200.327.
If awarded the contract for the work, the bidder agrees to begin construction activities within 30
calendar days of contract execution and to constantly and faithfully execute and complete the
contracted work within 20 working days once construction begins. Liquidated damages shall be
$400 per day for each working day in excess of 20 working days. All work must be completed by
August 1, 2026.
