Description

GENERAL: THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT AND IS NOT A REQUEST FOR COMPETITIVE QUOTES. This non-competitive award is implemented by FAR 13.106-1(b), as it has been deemed that only one source is available to meet this specific requirement. The US Army Corps of Engineers, Wilmington District, Wilmington, NC intends to issue a sole source award to BFPE international, Inc. (UEI: c PZCKK1GKZ5S2) to for services to repair/replace the underground raceways and conduits that connect the Vehicle Gate’s Card Reader to the HQ Building, install a Lenel Intelligent Controller with Wireless Bridge Kit and Weatherproof Enclosure to act as a back-up system for the gate reader, and install a keypad with pedestal that will connect to the outbound gate’s motor to allow manual access to the gate. BFPE International was the first-tier subcontractor under PO W912PM22P0025 to provide services to make those repairs and upgrade the existing Access Control Security System and related electrical infrastructure which operated the building’s Common Access Card (CAC) Enabled Card Access Readers, the front Vehicle Access Point, and its Intercom Systems. As such BFPE was the original OEM installer certified to install and repair the affected system components. They possess an inimitable knowledge of the current system wiring and Lenel S2 Security System in place and possess the necessary clearances to work on the security system.



APPLICIABILITY OF AUTHORITY:



The Statutory authority permitting other than full and open competition for this acquisition is the and the Department of the Air Force Federal Acquisition Regulation Supplement (DAFFARS). FAR 13.106-1(b)(1)(i) justifies limiting the source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available.





The purpose of this action is to provide notice of intent for which the Government intends to solicit and negotiate with only one source, BFPE, under the authority of Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold, the Contracting Officer may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilizations). This notice of intent is neither a request for competitive quotes nor a solicitation for offers. However, all proposals received by the date specified herein will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Interested parties may identify their interest and may submit a quote and/or capability statement by 10:00 AM CST, 18 April 2024. Capability statements and quotes shall be sent via email to joshua.s.craven@usace.army.mil.



The attached Sole Source Justification outlines the Contracting Officer's justification and reasoning to award a sole source award to BFPE International.



This notice meets the requirement set forth by FAR 6.305 Availability of the justification (a) The agency shall make publicly available the justification required by 6.303-1 as required by 10 U.S.C. 3204(f) and 41 U.S.C. 3304(f).
