In accordance with (IAW) Federal Acquisition Regulation (FAR) Part 19.1406 - Sole Source Awards to Service-Disabled Veteran-Owned Small Business Concerns, a contracting officer shall consider a contract award to a SDVOSB concern on a sole source basis (see FAR 6.302-5(b)(6)) before considering small business set-asides provided none of the exclusions of 19.1404 apply and --
(1) The contracting officer does not have a reasonable expectation that offers would be received from two or more service-disabled veteran-owned small business concerns;
(2) The anticipated award price of the contract, including options, will not exceed (ii) $4M for a requirement within any other NAICS code (that is not manufacturing);
(3) The requirement is not currently being performance by an 8(a) participant under the provisions of subpart 19.8 or has been accepted as a requirement by SBA under subpart 19.8;
(4) The service-disabled veteran-owned small business concern has been determined to be a responsible contractor with respect to performance; and
(5) Award can be made at a fair and reasonable price.
Upon reviewing the exclusions of FAR 19.1404, none of them apply to this acquisition, as further explained below:
This requirement cannot be satisfied through award to Federal Prison Industries, Inc. or AbilityOne participating non-profit agencies for the blind or severely disabled. The resultant contract action will not be an order under a indefinite-delivery contract or a Federal Supply Schedule. Furthermore, this particular requirement is not currently being performance by an 8(a) participant, and it is not a requirement that SBA has accepted under the 8(a) program.
In accordance with FAR 6.302-5(b)(6), a sole source award to a SDVOSB is authorized by statute, the Veterans Benefits Act of 2003 (15 U.S.C. 657f).
In light of the urgency of this requirement and the market research conducted IAW the complexity of the requirement, only one service-disabled veteran-owned company has been identified who can perform these range cleaning services as soon as possible. Of the two other companies identified through market research who can perform these services, neither of them are certified as SDVOSB concerns or identified as any other socioeconomic category what would allow for a sole source award IAW FAR 19. The SDVOSB identified to perform these range cleaning services is Superior Tasking Advantage Contracting, Inc. (CAGE Code 6UVX0). This company has been deemed a responsible contractor with a satisfactory performance record and is capable of completing the necessary services as soon as possible. This particular vendor does not yet offer these services through an existing contracting vehicle such as the General Services Administration (GSA).
