The United States Department of Agriculture (USDA) Animal Plant Health Inspection Services (APHIS) , Emergency and Regulatory Compliance Services (ECRS) Facility in Riverdale, Maryland intends to negotiate a firm fixed Priced purchase to replace 10 PortaCounts (Model 8048) and purchase 24 Licenses. The Program currently has 33 TSI Brand Portacounts in use.

The United States Department of Agriculture (USDA) Animal and Plant Health Inspection Services (APHIS) currently operates a robust Respiratory Protection Program in which it has used PortaCounts™ provided by TSI Incorporated since 1998. APHIS is initiating the replacement of the second reiteration of the units (Model 8038) with the updated Model 8048. The older Model 8038s have entered their shelf life for production. Additionally, the older units are limited in their ability to perform firmware updates needed for performance.
The rationale used for permitting this noncompetitive acquisition is In accordance with FAR 13.106-1(b)(1)(i) and FAR 13.106-3(b)(3)(i);
For acquisitions greater than the micro-purchase threshold but less than the Simplified Acquisition Threshold (SAT) the Contracting Officer may solicit from one source only if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, etc.).

The TSI brand respirator test system was originally chosen because it was the only known system equipped to test the N95 respirators which are used by several USDA facilities.
TSI is the Manufacturer for the Porta Counts used and they perform their own cleaning and calibration services. TSI brand respirators have been very reliable with long term operations enabling APHIS to keep the respiratory protective program active, specifically during zoonotic outbreaks and eradication efforts. The new Model 8048s will have the ability to transition data seamlessly into APHIS’ Environmental Quality Information System (EQuIS) used to manage employee medical monitoring surveillance.
This Notice of Intent is not a request for competitive proposals. No solicitation documents are available and telephone requests will not be honored. However, if a firm believes it can meet the requirements it must furnish information about its products and services to the Contracting Officer by 4:00pm. (MST) by 04/03/2024 . Supporting evidence must be furnished in sufficient detail to demonstrate the ability to comply with the above requirement.
