Bid Attributes
1 INTRODUCTION
The City of Hot Springs, Arkansas, is seeking proposals for a food concessionaire to operate the concession booth
at the City's Kimery Park. This Request for Proposals (RFP) contains all the information necessary to prepare and
submit a proposal. Prospective Respondents are advised to study this RFP completely and follow the instructions
exactly.
The City maintains Kimery Park at 271 Kimery Street in Hot Springs. This facility has four (4) softball fields, seven
(7) tennis courts, eight (8) soccer fields, two (2) sets of restroom facilities, a concession area and storage rooms.
Many major capital improvements to the park have been taken place over the years and are currently continuing.
Kimery Park is available for public use year-round and has several different groups and organizations the utilize the
park for various sports, leagues, practices, tournaments and special events. The fields are utilized on a reservation
system through the City's Sport Recreation Department. Any group, organization, league, independent team, etc.
may use the fields on a first come, first serve basis when they are not previously reserved. Softball draws the
largest number of participants, spectators, and consists primarily of the following league and tournaments:
City-sponsored leagues (date are approximate and depend on weather):
A) Youth Softball Leagues: Spring/Summer - April to early June. Fall - late August to early November.
B) Adult Softball Leagues: Springs/Summer - March to early July. Fall - late July to October.
Independent Leagues:
A) Senior Softball Leagues: Spring/Summer - March to July. Fall - August to October.
B) Church Adult Leagues: Spring/Summer - May to late July.
Softball Tournaments:
Approximately twenty (20) - thirty (30) tournaments of varying ages and classes (average twenty (20) teams per
tournament with ten (10) players per team, average two (2) days per tournament, and average spectators = 500
per day).
Private tournaments and special events will be approved by the City.
It should be noted that the soccer fields are currently used for practice by the Hot Springs Futbol League in the
Spring and Fall. The tennis courts are used year-round including individual play, school team practices, instruction
for youth and adults and anticipate tournaments will be held in the future.

3 SCOPE OF SERVICE
The following scope of service describe the minimum requirements for this type of service:
1. The City will provide the space for the food concession and access to the space, but the concessionaire must
utilize the space in an "as is condition". The City will not furnish any additional facilities or equipment nor maintain
the booth's interior such as cleaning and repairs once the concessionaire begins operation. Potential
concessionaires are strongly encouraged to visit the site prior to submission of a proposal. To visit the site
arrangements may be made by calling the Sport Recreation office at 501-651-7740. The concessionaire shall
furnish and supervise all necessary personnel, merchandise, equipment, and all other items necessary for the
conduct of a concession operation except as a part of the "as is condition".
2. The concession rights granted pursuant to the RFP shall apply only to those areas agreed upon by the City at
the time of the contract, leaving several secured areas accessible only to the City such as storerooms for field
equipment and program maintenance. Access to the areas containing electrical meters and other vital equipment
must be granted to the City although effort will be made to minimize exposure to those areas.
3. The concessionaire is responsible for providing any insurance necessary to operate such a facility, including but
not limited to public liability insurance ($100,00 single limit and $300,000 cumulative minimum) and shall be
responsible for complying with all federal, state, and local laws including but not limited to compliance with
applicable public health laws and regulations. Nothing contained herein shall have any effect upon the immunity
granted to the City under existing case law and Arkansas Code Annotated 21-9-301, which is herby reserved by the
City without diminution.
4. The concessionaire must operate the concession booth a reasonable number of hours per week to
commensurate with the usage of the fields and scheduled leagues, tournaments, and special events. This schedule
must be reviewed and approved by the City.
5. The concessionaire must maintain the booth in a state of cleanliness and order at all times and shall be
responsible for accomplishing any necessary repairs to the interior of the booth.
6. The City will provide the concessionaire with one set of keys to the access gate and the concession booth. These
keys may not be duplicated without the permission of the City and shall be returned at the end of each softball
season or as required by the City.
7. All equipment, sale items, and property shall be the sole responsibility of the concessionaire and shall be left in
the booth at the concessionaire's risk. The City shall not be held responsible for the concessionaire’s equipment,
sale items, and property other than providing a security alarm system for the area.'
8.The successful respondent shall reimburse the City of the annual Health Department license.
9. The successful respondent will be responsible for collecting and remitting all applicable taxes. Failure to pay
taxes in a timely manner to any entity will be grounds for immediate termination of the contract.
The contract will be for one (1) year with four(4) twelve (12) month terms, subject to annual budget approval by the
Hot Springs Board of Directors. Contract will automatically renew annually unless either party supplies thirty (30)
day written Notice of Cancellation. Any escalation in price shall be subject to paragraph 29 of the Terms and
Conditions of Bidding. City reserves the right to accept or decline any and all price increases.
4 STATEMENT OF REQUIREMENTS

Requirements."
