Mobile County
Mobile County is taking sealed bids for labor, equipment, materials, and any incidentals
required to complete the work required for the following project of the County:
Project Number MCP-003-23/RA49-02-23 for Resurfacing, Restoration and Rehabilitation
(Full Depth Reclamation) of Blackwell Nursery Road South from Ed George Road to
Snow Road.
Forty (40) working days are allowed for the construction of this project.
This bid is intended to comply with the Rebuild Alabama Act, No. 2019-2, as amended, and
Alabama Code Title 39, the Alabama Public Works Law, as amended. Bidders shall be
required to comply with the provisions of the Rebuild Alabama Act, No. 2019-2, as
amended, and Alabama Code Title 39, Public Works Law, as amended, regardless if the
requirement is explicitly detailed in the bid proposal or not.
Only bids from contractors or material suppliers listed on the Alabama Department of
Transportation (ALDOT) approved list of contractors and material suppliers will be
accepted. All bids must be marked with the word “BID” on the outside of the bid package
along with Bid Proposal for Project MCP-003-23/RA49-02-23 for Blackwell Nursery Road
South, the bid date and the Alabama General Contractor’s License Number.
The contractor shall meet all Alabama Department of Transportation (ALDOT) Bonding and
Licensing requirements as well as all applicable laws, ordinances, and codes of the U. S.
Government, the State of Alabama, any relevant municipality, and the COUNTY, and,
specifically and without limitation, shall comply with all provisions of the Beason-
Hammond Alabama Taxpayer and Citizen Protection Act, commonly referred to as the
Immigration Act. If applicable to a contract resulting from this bid invitation, the successful
bidder must comply with the Mobile County Contractor Felony Investigation Policy,
available in the County Engineering Department, or online at
https://www.mobilecountyal.gov/government/departments/engineering/engineering-
downloads/.
Liquidated damages for non completion of the work within the time limit agreed upon will
be assessed in accordance with the terms of the contract.
A pre-bid conference will be held on MARCH 13, 2024 at 10:30 AM Central Time in the
Mobile County Engineering Department, Mobile Government Plaza Sixth Floor South
Tower Mobile, Alabama. All prospective bidders should have a representative present at
the pre-bid conference.
No bids will be considered unless the bidder, whether resident or non-resident of Alabama,
is properly licensed and qualified to perform the work described herein in accordance with
all applicable laws of the State of Alabama. This shall include evidence of holding a current
certificate to engage in general contracting in the State of Alabama, issued by the State of
Alabama Licensing Board for General Contractors, Montgomery, Alabama, as required by
Section 34-8-2, Code of Alabama (1975). Any contractor that desires to bid as a prime
contractor must have at least one of the following major classifications of license per Section
230-X-1-.27 of the State of Alabama Licensing Board for General Contractors Administrative
Code:
1.c.) Highways and Streets
1.d) Municipal and Utility
1.e) Heavy and Railroad Construction
Out of state corporations shall furnish a certificate of authority to transact business in
Alabama. Out of state limited liability companies shall provide proof of registration to
transact business in this state. Prior to the award of a competitively bid contract to a
contractor having one or more employees in the State of Alabama, Alabama law requires
that the contractor provide the County proof of enrollment in E-Verify (see
www.uscis.gov/everify).
Sealed bids will be received by the Mobile County Commission at 205 Government Street,
8th Floor South Tower, Mobile, Alabama until 10:00 AM Central Time on MARCH 20, 2024,
and then publicly opened as soon thereafter as practicable. Award will be made at the next
regularly scheduled meeting of the Mobile County Commission.
Specifications are on file and are available in the office of CIVIL SOUTHEAST, LLC 9086-
F MERRITT LANE, DAPHNE, AL 36526 upon payment of a refundable (if plans are
returned in reusable condition within 10 days of bid opening) deposit of SEVENTY-FIVE
DOLLARS ($75.00). Checks shall be made payable to CIVIL SOUTHEAST, LLC.
County reserves the right to accept or reject all Bids or any portion thereof.
This project will be eligible for a Certificate of Exemption as provided by Act 2021-372. Once
the low bidder is determined, the County will request a copy of the Form ST-EXC 1 prior to
award of the bid to the lowest responsible bidder. The contractor shall provide the County
with the Form ST-EXC 1 within 48 hours of the County’s request.
