Description:

The City of San Leandro is the recipient of two competitive Metropolitan Transportation Commission (MTC) Priority Development Area (PDA) grants to further planning efforts for the Bay Fair Transit-Oriented Development (TOD) District. The PDA grants will enable the preparation of a Bay Fair TOD Sub-Area 1 Development Plan (Development Plan) and related Bay Fair TOD Specific Plan Amendments (Amendments).

The City of San Leandro is seeking proposals from qualified Consultants to support the preparation of the Development Plan and Amendments, which will build upon prior planning efforts in partnership with the community, key stakeholders, and property owners to:

  • Address regulatory, ownership and market changes and opportunities;
  • Promote sustainable development and travel patterns;
  • Advance solutions for key infrastructure challenges and access barriers as well as operational considerations for existing uses;
  • Provide additional parameters to streamline future development; and
  • Implement MTC’s Transit Oriented Communities (TOC) Policy.

AND SPECIFIC PLAN UPDATE
I. INTRODUCTION
The City of San Leandro is the recipient of two competitive Metropolitan Transportation
Commission (MTC) Priority Development Area (PDA) grants to further planning efforts for the
Bay Fair Transit-Oriented Development (TOD) District. The PDA grants will enable the
preparation of a Bay Fair TOD Sub-Area 1 Development Plan (Development Plan) and related
Bay Fair TOD Specific Plan Amendments (Amendments). The City is seeking proposals from
qualified Consultants to support the preparation of the Development Plan and Amendments,
which will build upon prior planning efforts in partnership with the community, key
stakeholders, and property owners to:

II. BACKGROUND
The Bay Fair TOD Specific Plan area covers 154 acres surrounding Bay Fair BART station in San
Leandro, California. The Bay Fair TOD Specific Plan was adopted in 2018 and amended in 2020.
Together, the Specific Plan and implementing B-TOD Zoning (2021) promote the long-term
sustainability and vibrancy of the Bay Fair area by:
Addressing long-term changes in market trends affecting retail generally and
regional malls specifically;
Addressing barriers to development and streamlining the development review
process to attract private investment;
Providing greater access to public funding targeted to TOD areas, including One
Bay Area Grant (OBAG) funds; and
Addressing displacement pressures and providing protections for existing naturally
occurring affordable housing at mobile home parks in the plan area.
Since the Specific Plan and B-TOD Zoning were adopted, the State, regional, and local policy
framework has evolved significantly, including:
Plan Bay Area 2050 regional long-range plan and related implementation;
State housing legislation related to 6th Cycle Housing Elements, objective
development standards, streamlined review of housing projects, and parking
reforms;
AB2923 and BART’s 10-Year Transit-Oriented Development Work Plan;
San Leandro’s 2021 Climate Action Plan and 2023 General Plan Environmental
Justice Element; and
San Leandro’s Certified 2023-2031 Housing Element, and related EIR that evaluated
up to 5,000 housing units and 375,000 sq. ft. of office in the Bay Fair TOD Area.
Additionally, key properties in the Bay Fair TOD have new owners resulting in opportunities for
adaptive reuse of up to 400,000 square feet of an aging mall for a transit-oriented employment
center and entitlement of a 497-unit multi-family development through the SB35 State
streamlining process.
In September 2022, the City kicked off a MTC grant-funded effort to prepare a Bay Fair TOD
Infrastructure Phasing and Financing study, which will be completed by December 2023. The
final deliverables will inform the next phase of planning for the Bay Fair TOD by providing a
high-level review and categorization of the list of capital projects and infrastructure
requirements identified in the Specific Plan. This effort will categorize the types of capital
projects and infrastructure that are most amenable to construction on a project-by-project
basis, funded privately, or through a centralized or cooperative financing mechanism (e.g.,
EIFD, CFD, impact fees). An implementation strategy will provide a review of potential risks and
barriers (e.g., regulatory, institutional, jurisdictional, logistical, and fiscal), as well as market and
economic risks as well as a pathway for overcoming risks and barriers and implementing
recommendations in the near-, mid-, and long-term.

In October 2022, MTC adopted a Transit-Oriented Communities (TOC) Policy that incentivizes
local governments to plan for areas within a half-mile of existing and planned transit stops and
stations in alignment with Plan Bay Area 2050. The TOC Policy establishes:
Minimum residential and commercial office densities for new development that can
be averaged to respond to local context and community input;
Affordable housing production, preservation and protection, and stabilizing
businesses to prevent displacement;
Parking management; and
Transit station access.
III. PROJECT OVERVIEW AND OBJECTIVES
The proposed Development Plan for Sub Area 1 (~72 acres) of the Bay Fair TOD District and
related Specific Plan Amendments are a strategic investment in the pre-development work
necessary to unlock the development potential at the center of the Bay Fair TOD District and
PDA. The Development Plan and Amendments will build upon prior planning efforts in
partnership with the community, key stakeholders, and property owners to:
Address regulatory, ownership and market changes and opportunities;
Advance and implement the vision of the existing specific plan;
Provide additional clarity on key development details such as parcelization, block
structure, circulation network, open space network, development phasing, parking,
infrastructure upgrades, development program, and financing;
Advance solutions for key infrastructure challenges and access barriers as well as
operational considerations for existing uses in the short, medium, and long-term;
Prepare the site for active development, with the opportunity for key parcels to
prepare viable development application(s), master plan(s), and/or development
agreement(s) in parallel with the City’s Development Plan and Amendments
process, and to submit such application(s) immediately upon completion of the
City’s process;
Find opportunities to complete development-readiness work that will reduce
planning, design, and/or engineering burden on individual property owners or
development applicants in the district;
Administer a planning process that is driven by the City, but that also accommodates
detailed input and feedback at important milestones from key property owners.
Ensure feasibility of proposed development concepts;
Provide additional parameters to streamline future development; and
Implement MTC’s Transit Oriented Communities (TOC) Policy.
The successful Consultant will propose a process and detailed scope of work that accomplishes
these objectives and incorporates key deliverables detailed below, while also identifying any
additions or refinements that will lead to a more effective process and successful development
plan. The City requests that project budgets include a 15%-20% contingency which could be
flexibly utilized, by mutual agreement between the City and the Consultant, for needs that arise
during the course of the project. Project proposals can include optional tasks or variations, and
there will be a scoping refinement and confirmation process as the first step in bringing the
selected consultant under contract and initiating the project. It is anticipated that the successful
