Stormwater Management Basin Improvements II, Various Locations
Sealed bids are invited for rehabilitation of the stormwater management basin improvements as
summarized below.
The project consists of the improvements to four existing stormwater management basins
located on private open space in the following subdivisions: Hawks Nest, Lynmoore, Wyndom,
and Academy Hills (basin and outfall on separate parcels). Work will include erosion and
sediment control measures, temporary bypass pumping, dewatering, removal and disposal of
accumulated sediment, removal and disposal of existing outlets structures and / or discharge
pipes, placement of new outlet structures, discharge pipes, rip-rap drainage chute, soil-cement
mixture, and/or flared end sections, backfilling and regrading, stabilization of embankments
and channels, removal of erosion control measures, and preparation of as-built plans in
accordance with the contract specifications and drawings. Temporary traffic control is to be
provided in accordance with Part 6 Temporary Control of the Delaware Manual on Uniform
Traffic Control Devices (MUTCD).
Bids addressed to the New Castle County Purchasing Division will be received by the Purchasing
Division, New Castle County Government Center, 87 Reads Way, New Castle, DE, 19720, telephone
(302) 395-5250 until 2:00 p.m. January 23, 2024, when they will be opened and read publicly.
Bid envelopes shall carry a clear notation Stormwater Management Basin Improvements II,
Various Locations” Contract No.: 2023-07, Bid No.: 24-2416. Plans and Specifications may be
obtained in the William J. Conner Building, 187-A Old Churchmans Road, Room 063, New Castle,
DE, 19720, on and after December 20, 2023 upon payment of $50.00 (non-refundable) for paper
copies, digital copies are provided without a fee by calling (302) 395-5749 or (302) 395-5251 or e-
mailing: john.wolos@newcastlede.gov or Monnica.newman@newcastlede.gov; .
Bids shall be accompanied by a bidder’s bond or certified check in an amount equal to 10 percent of
the bid price, payable to New Castle County and conditioned to be forfeited to said County for failure
to enter into a contract, if awarded.
Awards, if any, will be made to the lowest responsible bidder. The County reserves the right to reject
all bids and to waive minor irregularities. Bidders are required to submit all Proposal pages with their
bid. The Proposal must be signed and sealed. A bid bond must be included with the Proposal. The
CRC form, if not already submitted, must be included with your submission. Any deviation from these
instructions may result in the rejection of your bid. The successful Bidder will be required to give bond
of a surety company, acceptable to the County, and licensed to do business in the State of Delaware,
in the amount of the contract price.
CONTRACTOR/SUBCONTRACTOR RESPONSIBILITY CERTIFICATION
Contractors proposing to submit a bid to New Castle County for a Public Works contract expected to
exceed $500,000 are required to complete and submit a signed original Contractor Responsibility
Certification (CRC) form. The New Castle County Department of Public Works Contracts Officer must
receive this executed form no later than the advertised date for bid submittals. Failure to submit the
form by that time shall result in the County’s inability to consider your bid for award. CRC forms
submitted by facsimile will not be accepted. Bidders are encouraged to submit the form in advance of
the bid. The form is printed in the specification and is also available at:

for additional requirements and information.
ALCOHOL & DRUG TESTING
New Castle County Code, Section 2.05.305 requires contractors and subcontractors to implement a
mandatory alcohol & drug testing program for their employees who work pursuant to a Public Works
contract. Included in the specifications for this project is an affidavit certifying compliance with the
Ordinance. This affidavit must be executed and submitted with the bid. Failure to submit the affidavit
by that time shall result in the County’s inability to consider your bid for award. Forms submitted by
facsimile will not be accepted.
AMERICAN RESCUE PLAN ACT
This contract is being funded in whole or in part with federal funds received from the American
Rescue Plan Act (ARPA). Bidders will be required to adhere to all applicable federal laws, regulations,
executive orders, and terms and conditions of the funding award. In addition, Bidder will be required to
adhere to all other federal, state and County laws, regulations, executive orders and terms and
conditions as applicable to this contract.
PREVAILING WAGES
The payment of prevailing ages as determined by the State of Delaware department of Labor to all
mechanics and laborers working on the project is required. A schedule of the rates for this project is
included in the specification.
PREBID MEETING
There will be pre-bid meeting at 9:00 a.m. on Thursday, January 04, 2024 in the Water Resources
Conference Room of the William J. Conner Building, 187-A Old Churchmans Rd., New Castle, DE.
TEAMS meeting invitations will be provided for those wishing to attend virtually.
PREQUALIFICATION
New Castle County will only accept bids from contractors prequalified with the County in the category
“D” Drainage Works. Prequalification forms are available from the Public Works Contracts Officer in
the William J. Conner Building, telephone 302-395-5749.
