New Castle County is seeking sealed bids for Portable Toilets and Septic Pumping,
Bid #24C-077
Interested parties are asked to submit proposals to New Castle County, Procurement Division, New
Castle County Government Center, 87 Reads Way, New Castle, DE 19720, stating their interest and
qualifications. Proposals must be received by 2pm on Wednesday, April 10, 2024 and must include one
(1) printed hard copy and one (1) USB drive containing an electronic version of the proposal within a
sealed envelope. The electronic submission will be considered the original, and must replicate the
printed hard copy, with all appropriate signed documents. If there are any discrepancies between the
two submissions, the original (electronic) submission is considered the official version for purposes of
evaluation. The hard copy is only reviewed if the electronic version cannot be viewed due to a technical
issue.
Delivery Method for Bid Submission Options:
- You can mail your bid submission to 87 Reads Way, New Castle, Delaware. However, it is
recommended to use a carrier that can guarantee delivery and provide tracking information, so
your bid submission packet arrives at the deadline date and time.
- You can deliver your bid submission packet in person prior to the Bid Opening to the Government
Center, located at 87 Reads Way, New Castle, DE 19720 between the hours of 8 a.m. and 3:30 p.m.
You can go inside the building to the lobby area and do either of the following:
1) call a member of Administrative Services at 302-395-5965 from the Lobby Phone or your
cell phone, and have a Procurement representative meet you in the lobby and accept your bid packet
and provide a receipt, or
2) you can ask the Receptionist to contact Procurement.
Please remember on the bid opening date, your bid submission must be turned in no later than 2:00
p.m. on Wednesday, April 10, 2024 to be accepted and you are welcome to attend the bid opening
meeting at that time.

Facsimile transmissions of bids are unacceptable and will be rejected without any notice to the
bidding vendor.
Bidders are responsible to retrieve the bid specifications and all addendums from the New
Castle County Purchasing website at www.newcastlede.gov/Bids.aspx.
Bidders must complete and submit with their proposal both the Non-Collusion
Statement/Signature Page and the Authorized Representative Procurement Affidavit which are
located as the final pages of the bid specifications. Failure to sign and return these documents
could result in your bid submission being rejected.
Pursuant to New Castle County Code and Delaware Law, each bidder must submit proof satisfactory to
the County or its designated representative that the bidder and every subcontractor possesses valid and
effective licenses required by the United States, State of Delaware, County and any applicable political
subdivision in which the project is located to do business within each such jurisdiction and to perform
the labor and/or supply the materials involved in the performance of the contract. No contract will be
executed prior to the submission of such proof and the acceptance thereof by the County or its
designated representative.
Awards, if any, will be made in conjunction with the Delaware Code, Subchapter 2, Chapter 69, Title 29,
and the New Castle County Code.

SUMMARY OF PURCHASING REQUEST
SCOPE OF WORK | SPECIFICATIONS
To provide portable toilets, servicing of portable toilets and provide septic pumping as specified by New
Castle County.
Vendor must have all applicable federal, state and local licenses and must perform work in accordance
with all applicable laws and regulations.
Vendor must be a licensed state of Delaware hauler, and shall dispose of all wastes to the satisfaction of
New Castle County. A photocopy of the State of Delaware hauler’s permit shall accompany bid.
Vendor shall have a local outlet located in New Castle County to have their bid considered.
REQUIREMENTS
New Castle County’s requirements for portable toilets servicing and septic pumping may include annual
(year-round), seasonal and short-term services with varied service frequencies.
Vendor must be capable of supplying handicapped accessible portable toilet units. New Castle County
will determine placement, but generally where more than one unit is required one would be
handicapped.
Vendor must be capable and willing to provide emergency service 24 hours per day, 7 days per week.
Emergency service may include cleanup, problems due to vandalism, storms, accidents, or otherwise.
Emergency service shall be provided within two (2) hours of notification and may include Saturday and
Sunday requests.
Vendor shall quote complete price for furnishing portable toilets that are in a good, clean condition, and
have the overall appearance of a new unit. Servicing of portable toilets shall be included in the price
quoted, and shall consist of complete removal of wastes, replacements of appropriate chemicals to
assure masking of odors, cleaning and disinfection of units, replacement of supplies, repairs to units and
equipment, and all other services necessary to maintain a neat and sanitary unit. Portable toilets must
be cleaned and disinfected twice a week, on Mondays and Fridays. A weekly written update must be e-
mailed to the NCC Property Maintenance Section indicating the date in which the units were serviced.
Portable toilets units shall be weatherproofed and vented to assure proper circulation of air and
reduction of odors. Holding containers must be leak proof.

New Castle County reserves the right to refuse delivery of any unit deemed unacceptable due to
appearance or damage.
Vendor must replace any unacceptable units within 48 hours of notification to ensure uninterrupted
service.
Portable toilets required for special events must be removed within 24 hours after completion of the
event.
Vendor must supply proof of servicing (i.e., route schedule with times and dates of servicing or another
means acceptable to New Castle County).
New Castle County reserves the right to add or delete locations or units as needed during the life of the
contract at the prices quoted.
Vendor must drive/park on paved surfaces only at all times, unless written permission is provided for
special circumstances.
DAMAGE WAIVER
If the portable toilets are damaged or destroyed, the County shall have no obligation to repair or replace
them. Furthermore, New Castle County shall not pay for the removal of damaged units.
NO SUBSTITUTIONS
Pursuant to New Castle County Code, Section 2.05.502A11b., New Castle County has the right to specify
a particular brand to match existing inventory. Therefore, no substitutions will be permitted.
FUNDING OUT
The continuation of this contract is contingent upon funding appropriated by New Castle County
Council.
RIGHT TO INSPECT
New Castle County reserves the right to use any information it sees fit to establish the ability and
qualifications of any bidder to perform all conditions of the contract, including, but not limited to,
visiting bidder's service facilities and requesting additional information after opening bids if such
inspection and additional information is considered necessary to properly evaluate a bidder's

qualifications and capabilities. This prevents New Castle County from entering into a contract with a firm
unable to furnish the quality of workmanship, materials, or services the County requires.
BASIS OF AWARD
The Division of Purchasing shall award this contract to the lowest responsible and responsive bidder(s)
who best meets the terms and conditions of the bid. The award will be made on the basis of price,
product evaluation, and prior history of service capability.
The Division of Purchasing reserves the right to reject any or all bids in whole or in part, to make
multiple awards, partial awards, award by types, award by sections, item by item, or lump sum total,
whichever may be most advantageous to New Castle County. There is no guarantee that New Castle
County will grant to any awardee any request for services and/or products.
Pursuant to County Code, New Castle County reserves the right to purchase goods, contractual, and
professional services from other governments and cooperative purchasing agreements when it is
determined by the Office of Technology and Administrative Services to be in the best interest of the
County.
INDEMNITY
Vendor shall indemnify, defend, and hold harmless New Castle County from and against any and all
claims, demands, suits, judgments, costs, and expenses asserted by a person or persons, including, but
not limited to, agents, employees, or volunteers of vendor, by reason of death or injury to persons, or
loss or damage to property, resulting from operations or use of services, products and/or equipment
purchased hereunder, or sustained in or upon the premises of New Castle County.
STATE OF DELAWARE BUSINESS LICENSE
Within seven (7) days from receiving a notice of award, the successful vendor shall either furnish the
County with proof of a Delaware Business Licensure or initiate the process of application where

CONTRACT ACCESSIBILITY
This contract shall be accessible to State agencies, political subdivisions, school districts, and volunteer
fire companies.
