Window and Glass Repair and Replacement

The Public Works department of New Castle County is seeking sealed bids for repairs and

replacements of windows and glass at various New Castle County maintained facilities.

Bidders are asked to submit sealed bids to New Castle County Purchasing Division, New Castle

County Government Center, 87 Reads Way, New Castle, DE 19720. Bids must be received by

2:00 p.m. on Wednesday, January 31st, 2024, and must be provided within a sealed envelope.

Questions concerning the project should be submitted in writing via email to Frank Penta at

frank.j.penta@newcastlede.gov by end of day on Monday, January 22nd, 2024.

INSTRUCTIONS FOR BID SUBMISSION

➢ Sealed envelopes must clearly display Bid # 25A-195, Window and Glass Repair and

Replacement in the lower left quadrant on the front.

➢ Facsimile transmissions of bids are unacceptable and will be rejected without any notice

to the bidding vendor.

➢ Bidders are responsible to retrieve the bid specifications and all addendums from the

New Castle County Purchasing website at www.newcastlede.gov/Bids.aspx.

Pursuant to New Castle County Code and Delaware Law, each bidder must submit proof

satisfactory to the County or its designated representative that the bidder and every

subcontractor possesses valid and effective licenses required by the United States, State of

Delaware, County and any applicable political subdivision in which the project is located to do

business within each such jurisdiction and to perform the labor and/or supply the materials

involved in the performance of the contract. No contract will be executed prior to the

submission of such proof and the acceptance thereof by the County or its designated

representative.

Awards, if any, will be made in conjunction with the Delaware Code, Subchapter 2, Chapter 69,

Title 29, and the New Castle County Code.

Window and Glass Repair and Replacement

SCOPE OF WORK | SPECIFICATIONS

New Castle County is seeking sealed bids for as needed repairs and replacements of windows

and glass at various facilities maintained by the County. Facilities included, but not limited to

are office buildings, libraries, public safety buildings and buildings within New Castle County

owned parks.

The types of windows that may need repair and replacement are as follows:

- Tempered Glass

- Laminated Glass

- Glazed Windows

- Fixed Windows

- Sliding Windows

- Double Hung Windows

- Casement Windows

- Pivoted Windows

- Metal Windows

- Gable windows

- Sash windows

- Lantern windows

- Bay windows

- Clerestory windows

- Corner windows

The thickness of the glass will vary based on the age, size, and scope of the facility.

REQUIREMENTS

The vendor will be in possession of a State of Delaware Business license as well as a New Castle

County Contractors license. Vendor will document proof of having provided these services for

ten (10) years and will provide references to corroborate a current professional relationship for

a minimum of five (5) years.

Due to the nature of the County’s work requests, vendors will be expected to be available 24/7

for emergency repairs, securing facilities, and cleanup. Non-emergency repair requests require

a next business day response.

Window and Glass Repair and Replacement

Any request for service at any Public Safety building may require a background check of the

employees to perform the service prior to work being performed.

NO SUBSTITUTIONS

Pursuant to New Castle County Code, Section 2.05.502A11b., New Castle County has the right

to specify a particular brand to match existing inventory specific to the glass being repaired or

replaced. Therefore, no substitutions will be permitted unless vetted and approved by the

appropriate member of our Public Works department.

FUNDING OUT

The continuation of this contract is contingent upon funding appropriated by New Castle

County Council.

FUNDING SOURCE

New Castle County’s funding source for this bid may be appropriated from our annual expense

budget, capital budget or from federally funded sources. Bidders should be aware that any

contract award funded, in full or in part, with funds obtained by the County through the

American Rescue Plan Act (“ARPA”), Coronavirus State and Local Fiscal Recovery (“SLFRF”)

funds are subject to the following.

In using SLFRF funds, the County must comply with: (1) regulations and guidance issued by the

United States Department of the Treasury regarding the use of CSLFR issued funds, including

the Compliance and Reporting Guidance for State and Local Fiscal Recovery Funds V.5.0 issued

September 20, 2022 (the “Guidance”), and the Final Rule issued by Treasury on January 6, 2022,

effective April 1, 2022, published at 87 Federal Register 4338 et seq. and 31 C.F.R. §§ 35.1 et

seq., as each may be amended; (2) the Uniform Administrative Requirements, Cost Principles,

and Audit Requirements for Federal Awards (the “Uniform Guidance”), 2 C.F.R. Part 200; and

(3) the U.S. Department of the Treasury Coronavirus State Fiscal Recovery Fund Award Terms

and Conditions (available at:

The County is appropriating funds that are deemed revenue replacement funds under

Expenditure Category 6.1 in the Guidance and 31 C.F.R. § 35.6(c) to the project contemplated

by this RFP. As such, the County’s use of the funds and contracting parties are subject to a

limited portion of the Uniform Guidance, as set forth in Section 13.15 of the Coronavirus State

and Local Fiscal Recovery Funds Final Rule: Frequently Asked Questions (Jul. 27, 2022), available

at https://home.treasury.gov/system/files/136/SLFRF-Final-Rule-FAQ.pdf.

COST

Please provide the cost as specified for this purchasing request on the Pricing Page. The cost

structure will be broken into two components. One component will by the hourly rate charged

to New Castle County for the work to be performed. The second component will be the

upcharge for materials to be purchased by the vendor. This upcharge will not exceed 15% of

the cost of the materials.

INVOICING

New Castle County requires a detailed itemized invoice with receipts for all labor and non-labor

related expenses to the job. Invoices must be segmented showing labor costs and

material/equipment costs separately. Documentation must be provided as back-up of all non-

labor related charges. Invoices may not be paid, and in such cases, they will be returned to the

vendor for correction. Miscellaneous expenses must be segmented on the invoice, with

appropriate back-up provided.

No lump sum invoice will be accepted.

RIGHT TO INSPECT

New Castle County reserves the right to use any information it sees fit to establish the ability

and qualifications of any bidder to perform all conditions of the contract, including, but not

limited to, visiting bidder's service facilities and requesting additional information after opening

bids if such inspection and additional information is considered necessary to properly evaluate

a bidder's qualifications and capabilities. This prevents New Castle County from entering into a

contract with a firm unable to furnish the quality of workmanship, materials, or services the

County requires.

Window and Glass Repair and Replacement

BASIS OF AWARD

The Division of Purchasing shall award this contract to the lowest responsible and responsive

bidder(s) who best meets the terms and conditions of the bid. The award will be made on the

basis of price, product evaluation, and prior history of service capability.

The Division of Purchasing reserves the right to reject any or all bids in whole or in part, to

make multiple awards, partial awards, award by types, award by sections, item by item, or lump

sum total, whichever may be most advantageous to New Castle County. There is no guarantee

that New Castle County will grant to any awardee any request for services and/or products.

Pursuant to County Code, New Castle County reserves the right to purchase goods, contractual,

and professional services from other governments and cooperative purchasing agreements

when it is determined by the Office of Technology and Administrative Services to be in the best

interest of the County.

INDEMNITY

Vendor shall indemnify, defend, and hold harmless New Castle County from and against any

and all claims, demands, suits, judgments, costs, and expenses asserted by a person or persons,

including, but not limited to, agents, employees, or volunteers of vendor, by reason of death or

injury to persons, or loss or damage to property, resulting from operations or use of services,

products and/or equipment purchased hereunder, or sustained in or upon the premises of New

Castle County.

STATE OF DELAWARE BUSINESS LICENSE

Within seven (7) days from receiving a notice of award, the successful vendor shall either

furnish the County with proof of a Delaware Business Licensure or initiate the process of

CONTRACT ACCESSIBILITY

This contract shall be accessible to State agencies, political subdivisions, school districts, and

volunteer fire companies.
