Notes:
The University of Nebraska is requesting proposals from qualified suppliers for
Agriculture Fertilizers and Chemicals to be used at various research farms and
campuses throughout the State of Nebraska.
In order to participate in this bid, you must submit your responses electronically

1 Bidder Requirements
I acknowledge reading and understanding the NU Bidder Requirements attachment.
All bids must be received by the system before the bid deadline. It is the responsibility of the bidder to
allow adequate time for reviewing and submitting their proposal before the deadline to ensure all

product(s) and/or service(s) sought by NU and hereby propose to supply such at the prices stated and in
accordance with this bid.

7 Audited Financial Statements
The bidder shall, upon request, provide NU with audited financial statements and that of any parent or holding
company for the three most recent fiscal years. Demonstrated financial ability and stability to ensure performance
under any awarded contract is critical to the evaluation process. Without stating specific reasons, the University
may reject or refuse to further evaluate any proposal based on the exercise of its judgment in its sole discretion that
the financial position presented in a proposal lacks the qualities that NU deems necessary to the project's success.
Entities unable to meet the requirements outlined in this paragraph may provide other information or guaranties,
which in the discretion of NU, meet its concerns regarding financial stability. Can you provide, if requested, three

descriptions contained in this bid; that all equipment and supplies will be free from defects in workmanship and
material; and to the extent that I know or have reason to know, the purpose for which the equipment and supplies
are intended will be fit and sufficient for such purpose and specifications contained in this bid.
The successful bidder will provide a warranty free of charge for all parts, equipment, transportation, technical
assistance, labor, and supervision necessary to correct any deficiency resulting from manufacturing defects for a
period of one (1) year after the final acceptance of materials, equipment, and services furnished. Thereafter the
manufacturer's warranty will apply.

1 Public Information
5 Bids submitted to the University are presumed to be public records. After opening to determine a successful bidder,
all bids will be available for public inspection. If a bid contains trade secrets, in progress and unpublished academic
or scientific research, or other proprietary or commercial information that, if released, would give an advantage to
business competitors and serves no public purpose, the bidder may designate portions of the bid as confidential. It
is the responsibility of the bidder to designate such content as confidential. Any reasonably segregable portions of
the bid not designated as confidential shall be provided for public inspection. Bidders shall not designate price
terms in bids, proposals, invoices, purchase orders, or other documents calling for the expenditure of public funds
as confidential or request they be withheld from public inspection
A bidder is solely responsible for providing the defense to any challenge to a decision to withhold information
contained in a proposal based upon the bidder’s identification of the information as confidential.
A bidder must submit any confidential material, as defined above, as a “separate” and “redacted”
attachment with their response in the NU eBid system. This attachment must be clearly
marked/identified as “Confidential”.

1 Contractor's Certificate of Insurance
6 I acknowledge and understand that prior to the commencement of any work, successful bidder is required to furnish
a certificate of insurance with coverage’s to bodily injury/personal injury/liability coverage, property damage liability
coverage, and workman's compensation coverage. This certificate must be on file in the Procurement Services
office prior to any commencement of work. It is absolutely necessary that "The Board of Regents of the University of
Nebraska as an additional insured” be added to the face of the certificate for all coverage except worker's
compensation. The above statement must be worded in this manner. It is also absolutely necessary that a
“Completed Operations Coverage” must be included as part of the vendor’s General Liability. In addition to
standard insurance coverage’s the vendor will be required to carry minimum: $1 million per claim & $3 million per
occurrence for liability and property damage.
