This Request for Quote (RFQ) is issued by the James City County Department of General Services to obtain Quotes from experienced and qualified contractors for Concrete Demolition, Disposal and the Install of an ADA Ramp at the James City County Recreation Center located at 5301 Longhill Road, Williamsburg, VA 23188

Award shall be made to the lowest responsive and responsible firm that complies with all the provisions of the RFQ.

All questions related to this RFQ shall be in writing and received by the James City County Purchasing Department, no later than 2:00 PM on March 14, 2024.

Liquidated Damages: $250.00 per calendar day after the time for Final Completion has expired.

I. PURPOSE AND INTENT
A. SCOPE OF CONTRACT
James City County is soliciting responses from experienced and qualified contractors for Concrete
Demolition, Disposal and Install of an ADA Ramp in accordance with specification and attachments
herein.
B. PERIOD OF CONTRACT
Contractor shall begin performance under this Contract on the date specified from Notice to Proceed issued
by the Project Manager. Once the contractor has received the Notice to Proceed, Contractor shall complete
all work within 30 days from the start date specified in the Notice to Proceed.
C. DEFINITIONS
Capitalized terms that are defined in the Virginia Public Procurement Act (VPPA), James City County
Purchasing Policy and the Hampton Roads Planning District Commission (HRPDC) have the same
meanings in this RFQ as are given in that law or policy. Capitalized terms not defined in the above
mentioned law or policy but used in this RFQ have the following meanings, unless the context clearly
requires otherwise. Undefined terms have their common meanings appropriate to their context.
1. Bid: The offeror or proposal of the Bidder submitted on the prescribed form setting forth the
prices for the Work to be performed.
2. Bid Documents: Documentation issued prior to the bid date, including documentation
accompanying the Bid (e.g., Drawings, Project Specifications, Addenda, Special Provisions, etc.)
and any Post Bid documentation submitted prior to the Notice of Award.
3. Bidder: Any individual, company, firm, corporation, partnership or other entity bidding on
solicitations and offering to enter into Contract with the Owner, James City County
4. Contract Documents: The Contract, including the Bid Documents, Notice of Award, Notice to
Proceed, Field Orders, Change Orders, and Modifications.
5. Contractor: The individual, company, firm, corporation, partnership or other entity which whom
the Owner has executed a Contract.
6. Construction: Shall mean building, altering, repairing, improving, or demolishing any structure,
building, road, drainage or sanitary facility, and any draining, dredging, excavation, grading or
similar work upon real property.
7. Competitive Sealed Bidding: Is a formal method of selecting the lowest responsive and
responsible bidder. It includes the issuance of a written Request for Quote (RFQ), public notice, a
public bid opening, and evaluation based on the requirements set forth in the RFQ. The Purchasing
Director may elect for prequalification of bidders or include a statement of any requisite
qualifications of potential Contractors in the RFQ. Multiple awards may be made when so
specified in the RFQ. An RFQ may be issued to potential Bidders electronically. Quotes may be
submitted electronically if specifically authorized in the RFQ.

8. Due Date: The date stated within this Request for Quote for receipt and opening of the Quotes.
9. Final Completion: All work, including punch list items noted at the final inspection, is complete to
the satisfaction of the Owner.
10. Hourly Rate: In this type of contract, the Bidder submits a stated hourly rate for the work to be
performed. The bid may include reimbursement for incidental expenses, such as materials and travel,
only if expressly provided for in the specifications of the Request for Quote.
11. Informality: A minor defect or variation of a bid from the exact requirements of the Request for
Quote which does not affect the price, quality, quantity or delivery schedule for the Good, Services,
Insurance or Construction being procured.
12. Insurance: has the meaning given in Virginia Code § 38.2-100.
13. Request for Quote (RFQ): A request which is made to prospective suppliers (bidders) for their
quotation on Goods, Services, Construction or Insurance desired by the Owner. The issuance of an
RFQ will contain or incorporate by reference the specifications and contractual terms and conditions
applicable to the procurement.
14. Liquidated Damages: Shall be the dollar amount calculated based on the total value of the Contract
and determined at the sole discretion of the Owner. If the Contractor breaches their Contract, they
shall compensate the Owner for its losses.
15. Non-Professional Services: All Services other than Professional Services, as identified in the
VPPA.
16. Notice to Proceed: A written notice given by the Owner to the Contractor fixing the date on
which the Contract Time will commence to run and on the which the Contractor shall start to
perform its obligations under the Contract.
17. Owner: This term refers to the public body, James City County.
18. Procurement: The receipt of Goods, Services, Insurance or Construction by a public body from a
nongovernmental source with payment from the public body or a third party.
19. Professional Services: Work performed by an independent Contractor within the scope of the
practice of accounting, actuarial services, architecture, land surveying, landscape architecture, law,
dentistry, medicine, optometry, pharmacy or professional engineering. “Professional services”shall
also include the services of an economist procured by the Sate Corporation Commission.
20. Project: The entire Work as described in the Contract Documents, including Work that is necessary
and incidental to the furnishings of all materials, services, equipment, labor and supplies required to
install, perform, and complete all items of Work in accordance with Contract Documents.
21. Proof of Insurance: A copy of the relevant portions of the insurance declaration page, or its
equivalent, showing continuing coverage at the required amounts.
22. Public Body: shall mean any legislative, executive, or judicial body, agency, office,
department, authority, post, commission, committee, institution, board, or political subdivision
created by the law to exercise some sovereign power or to perform some governmental duty

and empowered by the law. Public body shall include any metropolitan planning organization
or planning district commission that operates exclusively within the Commonwealth of
Virginia.
23. Purchasing Director: Responsible for managing all James City County procurement activity and
implementing the James City County Purchasing Policy.
24. Purchasing Policy: The applicable provision contained in the James City County Purchasing Policy, as
amended.
25. Responsible Bidder: Shall mean an individual, company, firm, corporation, partnership, or other
organization who has the capability in all respects to perform fully the Contract requirements and the
moral and business integrity and reliability which will assure good faither performance and who has
been prequalified if required.
26. Responsive Bidder: Shall mean an individual, company firm, corporation, partnership, or other
organization who has submitted a Bid that conforms in all material respects to the Request for Quote.
27. Shall: The term “shall” is mandatory.
28. Substantial Completion: The date certified by the Owner when the construction of the Project or a
specified part thereof is sufficiently completed in accordance with the Contract Documents, including
completion of all tests, so that the Project or specified part can be utilized for the purpose for which it is
intended.
29. VPPA: The Virginia Public Procurement Act, Virginia Code §§ 2.2-4300 et seq.
30. Work: All labor, materials, equipment, transportation, supervision or other facilities, duties, or
incidental necessary for execution and completion of the Project in compliance with the Contract
Documents.
D. COMPETITION INTENDED
It is the Owner’s intent that this solicitation permit competition. It shall be the Bidder’s/Offeror’s
responsibility to advise the Purchasing Director in writing if any language, requirement, specification, etc.,
or any combination thereof, stifles competition or inadvertently restricts or limits the requirements stated in
this solicitation to a single source. The Purchasing Director must receive such notification not later than
five (5) business days after the solicitation release date.
E. ORDER OF PRECEDENCE
Procurement by James City County is governed by the James City County Purchasing Policy, as amended,
and the Virginia Public Procurement Act, Sections 2.2-4300 et seq. of the Code of Virginia, as amended.
If an inconsistency exists between the Specifications of this RFQ, the General Provisions, Contract, or
other included document, or the Purchasing Policies and State Procurement Law, the inconsistency shall
be resolved by giving precedence to the following documents in the following order:
1. Virginia Public Procurement Act, as amended, except those provisions adopted by James City
County in the, James City County Purchasing Policy
2. The Specifications of Bidding contained in (Section II) of this Invitation to Bid, except to the
extent modified through negotiation permitted by VPPA when the low bid exceeds the
