THIS PROPOSAL WILL RESULT IN A SERVICE CONTRACT WHICH USES A FIXED PRICE UNIT COST SCHEDULE. It is the intent of Plano ISD to award one or more contract(s) as a result of this Job Order Contract/Indefinite Delivery Indefinite Quantity (JOC/IDIQ) Competitive Sealed Proposal (CSP) for use by Plano ISD.

This JOC/IDIQ CSP will be procured following Texas Education Code (TEC) Section 44.031(a), Purchasing Contracts and Texas Government Code (TGC) Chapter 2269, Contracting and Delivery Procedures for Construction Projects, specifically TGC Subchapter I, Sections 2269.401-458. Job orders will be awarded for the maintenance, repair, alteration, renovation, remediation, or minor construction of a facility if the work is of a recurring nature but the delivery times are indefinite and indefinite quantities and orders are awarded substantially on the basis of pre-described and pre-priced tasks that are specified in the priced task list included in this document.

In no event shall a job order issued as a result of this JOC/IDIQ CSP be used in connection with a building or structure that is incidental to a project that is primarily a civil engineering construction project. TGC Section 2269.402(2).

In compliance with TGC Section 2269.403(b), Plano ISD is establishing the maximum aggregate contract price for all contracts awarded by the Plano ISD under this JOC/IDIQ CSP at $600 thousand. This maximum aggregate contract price is in no way a guaranteed amount of funds or projects under this procurement and is no guarantee of work. It is merely a maximum aggregate contract price threshold required by law.

An order for a job or project, under the JOC/IDIQ agreement, must be signed by the governmental entity’s representative that solicits the Job Order. The job order may be (1.) a fixed price, lump-sum contract based substantially on contractual unit pricing applied to estimated quantities; or (2.) a unit price job order based on the quantities and line items delivered.

1.1 Because the prospective contract is a job order contract, the base term of the prospective contract is a period of two (2) calendar years, and Plano ISD may elect to extend any contract awarded pursuant to this CSP annually for up to three (3) additional one-year renewal terms. TGC Section 2269.409, or as otherwise provided by law.

Sec. 1001.002. DEFINITIONS. In this chapter:(1) "Board" means the Texas Board of Professional Engineers.(2) "Engineer" means a person licensed to engage in the practice of engineering in this state.

Sec. 1001.053. PUBLIC WORKS. The following work is exempt from this chapter:(1) a public work that involves electrical or mechanical engineering, if the contemplated expense for the completed project is $8,000 or less;(2) a public work that does not involve electrical or mechanical engineering, if the contemplated expense for the completed project is $20,000 or less; or(3) road maintenance or improvement undertaken by the commissioners court of a county.
