PREFACE:

The Port Authority of New York and New Jersey (“Port Authority”) is planning to replace the existing midtown bus terminal under a phased approach (“Bus Terminal Replacement Program” or “Program”). The Draft Environmental Impact Statement (“EIS”) for the Port Authority Bus Terminal Replacement Program was published by the Federal Transit Administration (“FTA”) on February 2, 2024, in the Federal Register. The public comment period commenced on February 2nd and public hearings were held during the week of February 20th. The public has been invited to submit comments on the Program by March 18th. These comments will be considered when preparing the Final EIS, and the Final EIS and Record of Decision are anticipated to be issued by FTA later this year. The Port Authority will not give final authorization to initiate physical construction of any project within the Program until completion of the Federal and City environmental review process.

The Port Authority is proceeding with the initial stages of its procurement processes for the first two components of the Program, the Dyer Deck-Overs project and the Staging & Storage Facility and Ramp Structure project, while the environmental review process moves forward. Once the environmental review process has run its course with appropriate approvals, the Port Authority will modify, as appropriate, these early action packages and move towards awarding initial construction contracts. By starting the early stages of its procurement processes, including the solicitation, evaluation, negotiation, and selection of contractors concurrently with the environmental review process, the Port Authority can be positioned to move the Program forward promptly when final regulatory approvals are received.

A separate procurement process for bidders for the Dyer Deck-Overs project is currently under way. The Dyer Deck-Overs project, when completed, will provide decks over the Dyer Ave roadway, which will reconnect portions of the community while also creating space for a variety of purposes once the overall Program moves forward, including bus operations during construction, and ultimately publicly accessible open space.

DESCRIPTION:

The Port Authority of New York and New Jersey (“Port Authority”) is seeking Statements of Qualifications (SOQs) in response to this Request for Qualifications (“RFQ”) from highly qualified and experienced firms interested in constructing the Staging and Storage Facility and Ramp Structure Project, a component project that is part of the multi-phase Midtown Bus Terminal Replacement Program. The purpose of the RFQ is to identify and shortlist up to three (3) prequalified firms to advance to the Request for Proposals (RFP) phase of the procurement.

The Port Authority of New York and New Jersey (Port Authority), in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 USC §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders or offerors that it will affirmatively ensure that for any contract entered into pursuant to this advertisement, businesses will be afforded full and fair opportunity to submit bids in response to this invitation and no businesses will be discriminated against on the grounds of race, color, national origin (including limited English proficiency), creed, sex (including sexual orientation and gender identity), age, or disability in consideration for an award.

Additionally, all bidders (including proposers, and respondents, as applicable) are notified that the Port Authority will ensure that, with respect to any contract/agreement entered into pursuant to this advertisement, disadvantaged business enterprises, minority business enterprises and woman-owned business enterprises, as applicable, will be afforded full and fair opportunity to submit bids, proposals and responses, as applicable, in response to this invitation, and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.
