Notes
The City of Davenport is seeking bids from qualified vendors for the CDBG Alley Program. This project extends storm sewer pipe under Washington St. from 15th St to 17th St. This sewer work is phased to minimize impact to traffic and parking (see plan sheet T-WF.6). An incentive is offered if work on Washington St finishes early (see Special Provisions for details). Working days are tracked separately for construction of a permeable alley adjacent to Washington St. An alternate bid is included for pavement replacement for the eastern portion of the alley and adjacent sidewalk work at Fillmore St, if funds allow. Davis-Bacon wages apply.



Bids must be submitted through the City of Davenport e-bidding system (https://davenport.ionwave.net); no emails, faxes, paper copies or any other submission method will be accepted. Each tab of the Invitation to Bid must be reviewed and responded to accordingly.

FOR THE BID #24-97 CDBG ALLEY PROGRAM WASHINGTON TO FILLMORE PERMEABLE ALLEY
FROM 16TH TO 17TH STREET WITH SEWER SEPARATION AND WORK INCIDENTAL THERETO IN AND
FOR THE CITY OF DAVENPORT, IOWA:
Sealed bids will be received by the City of Davenport, via the electronic submission system,
https://davenport.ionwave.net until 9:00 AM CT the 8th DAY OF MAY 2024 for the related work as described
in the specifications and contract documents, now on file. Bids may be acted upon by the City Council at a
subsequent meeting.
Contractors and subcontractors on this project will undergo a standardized evaluation upon completion of the
work. The results of this evaluation may influence the determination of the contractor’s eligibility to bid on
future projects as governed by the purchasing policies and city code of the City of Davenport.
NOTE: This is a Federally funded project. Note in the attachments there is additional
paperwork that must be completed and submitted.
A. The proposed work includes all labor, materials, tools, supplies, utility and transportation services,
equipment and all incidentals necessary for the Bid #24-97 CDBG ALLEY PROGRAM
WASHINGTON TO FILLMORE PERMEABLE ALLEY FROM 16TH TO 17TH STREET WITH SEWER
SEPARATION
B. All work shall be done in strict compliance with the plans and specifications prepared by
Veenstra & Kimm, Inc. and City Staff. Copies of plans and specifications may be obtained from the
City of Davenport’s electronic bid submission system, https://davenport.ionwave.net. You must be
registered as a supplier in the system to submit a bid. This is a one-time, no-fee registration. Vendors
are encouraged to start building their bid early with the required attachments. The system will save
your work.
C. Each bid shall be made in the electronic system no later than May 8, 2024 @ 9:00 AM CT.
The system will not accept late bids. No paper, faxed, or emailed bids will be accepted.
D. Prices in bid should be free of all sales taxes. Pursuant to Iowa Code sections 422.42 (15) & (16),
the awarded contractor will be issued a tax exemption certificate to purchase construction materials
(within the state of Iowa) that will be incorporated into real property for this project tax free.
E. For all bids over $100,000, the City of Davenport requires a Bid Bond of 5% of the bid amount. A
copy of the front page of the bid bond must be attached in the “Response Attachments” tab of the
bid package. Bids over $100,000, submitted without a bid bond will not be considered.
F. For awarded bids over $100,000, the awarded contractor will be required to furnish a Performance
Bond in an amount equal to one hundred percent (100%) of the Contract amount, and said bond to
be issued by a responsible surety approved by the City and shall guarantee the faithful performance
of the Contract and the terms and conditions therein contained.
G. Working Days This project is phased. The contractor shall begin construction on the sewer work or
before the date specified and complete all sewer work, including final cleanup and removal of all equipment
within 45 working days. The contractor may begin construction on the green alley work at their discretion,
and working days will begin when traffic control is removed from the travel lanes from the sewer phase or
when the contractor elects to begin, whichever occurs first. All green alley work, including final cleanup
and removal of all equipment, within 45 working days.
H. Liquidated Damages - Liquidated damages for the sewer phase shall be $1,200.00 per day;
liquidated damages for the green alley phase shall be $500.00 per day.
I. Incentive The City offers an incentive of $1,200.00 per working day that the sewer work is
substantially complete in 39 working days or less.
J. Davis-Bacon prevailing wages will apply to this project.
K. Manufacturer’s written warranties and guarantees shall also be required from the awarded bidder.
L. Bidders must include with the bid submittal a Certificate of Insurance for General Liability, Workers
Compensation, and Vehicle insurance coverages. The limits of the policies shall be as specified in
the “General Contract Conditions”, which may be obtained from the City’s website
(www.cityofdavenportiowa.com).
M. Funding for this project is federal CDBG funding. See information requirements at the end of this
document. Davis Bacon wages will apply to this project. All CDBG paperwork must be signed and agreed
to.
N. Specifications and contract documents governing the proposed improvements and proceedings of the
City Council referring to this proposed improvement are hereby made part of this notice and a proposed
contract shall be executed in compliance with the “Instructions to Bidders” and with the “General Contract
Conditions”.
O. Payments to the contractor for such improvement will be made monthly in warrants as specified in the
“General Contract Conditions” By virtue of the statutory authority, preference will be given to products
and provisions grown and coal produced within the State of Iowa and as specified in the “General
Conditions”.
P. The City reserves the right to reject any or all bids and to waive technicalities and irregularities, if it is
deemed in the public interest to do so.
Q. Attention is called to the fact that the contractor must ensure that employees and applicants for
employment are not discriminated against because of race, color, creed, religion, sex, gender identity or
expression, national origin or ancestry, sexual orientation, age, marital status, familial status, physical or
mental disabilities or political beliefs and affiliations.
R. Potential prime contractors are encouraged to contact DBE sub-contractors. For a listing of certified DBE
contractors, visit the State of Iowa's website at https://www.iowadot.gov .
The work to be performed under this contract is subject to the requirements of section 3 of the Housing and Urban
Development Act of 1968, as amended, 12 U.S.C. 1701u (section 3). The purpose of section 3 is to ensure that
employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by
section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons
who are recipients of HUD assistance for housing.
The parties to this contract agree to comply with HUD's regulations in 24 CFR part 135, which implement section 3.
As evidenced by their execution of this contract, the parties to this contract certify that they are under no contractual
or other impediment that would prevent them from complying with the part 135 regulations.
The contractor agrees to send to each labor organization or representative of workers with which the contractor has
a collective bargaining agreement or other understanding, if any, a notice advising the labor organization or workers'
representative of the contractor's commitments under this section 3 clause, and will post copies of the notice in
conspicuous places at the work site where both employees and applicants for training and employment positions can
see the notice. The notice shall describe the section 3 preference, shall set forth minimum number and job titles
subject to hire, availability of apprenticeship and training positions, the qualifications for each; and the name and
location of the person(s) taking applications for each of the positions; and the anticipated date the work shall begin.
The contractor agrees to include this section 3 clause in every subcontract subject to compliance with regulations in
24 CFR part 135, and agrees to take appropriate action, as provided in an applicable provision of the subcontract or
in this section 3 clause, upon a finding that the subcontractor is in violation of the regulations in 24 CFR part
135. The contractor will not subcontract with any subcontractor where the contractor has notice or knowledge that
the subcontractor has been found in violation of the regulations in 24 CFR part 135.
The contractor will certify that any vacant employment positions, including training positions, that are filled (1)
after the contractor is selected but before the contract is executed, and (2) with persons other than those to
whom the regulations of 24 CFR part 135 require employment opportunities to be directed, were not filled to
circumvent the contractor's obligations under 24 CFR part 135.
Noncompliance with HUD's regulations in 24 CFR part 135 may result in sanctions, termination of this contract for
default, and debarment or suspension from future HUD assisted contracts.
With respect to work performed in connection with section 3 covered Indian housing assistance, section 7(b) of the
Indian Self-Determination and Education Assistance Act (25 U.S.C. 450e) also applies to the work to be performed
under this contract. Section 7(b) requires that to the greatest extent feasible (i) preference and opportunities for
training and employment shall be given to Indians, and (ii) preference in the award of contracts and subcontracts
shall be given to Indian organizations and Indian-owned Economic Enterprises. Parties to this contract that are
subject to the provisions of section 3 and section 7(b) agree to comply with section 3 to the maximum extent
feasible, but not in derogation of compliance with section 7(b). (P.O. #2405142)
